NB man will not face charges

Grand jury didn't have supporting evidence

A Douglas County grand jury has decided a North Bend man should not face a charge of criminally negligent homicide in the death of Heidi Johnson.

Douglas County Deputy District Attorney Deborah Stoll presented evidence against John Flaxel last week to the grand jury.

“It found insufficient evidence to indict,” she said.

Flaxel, 73, was driving back from the Willamette Valley on Jan. 3 when his Toyota Sequoia crossed the centerline near milepost 20 of state Highway 38. It hit a Ford pickup, then crashed head-on into Johnson’s Volkswagen Jetta, which caught fire. Johnson, a 2006 graduate of North Bend High School, was driving back to Lane Community College for the winter term. She died in the crash.

Flaxel was not arrested following the accident, and without a grand jury indictment, the district attorney’s office can’t proceed with the homicide charge, Stoll said.

Prosecutors did not think drugs or alcohol were involved, so the only charge available in such a case was criminally negligent homicide, she said.

“It appeared that Mr. Flaxel caused the crash,” she said. “That’s why we present to the grand jury.”

Flaxel pleaded no contest to a careless driving citation in August and paid a $720 fine.

The occupants in the Ford suffered injuries, as did Flaxel and his wife, Joy, who was riding with him in the Toyota.

Flaxel’s injuries have healed, but his wife won’t fully recover from the back and neck injuries she suffered in the crash, said Nick Nylander, Flaxel’s attorney in the traffic citation case.

The grand jury could reconsider the homicide charge if new evidence is presented, but Stoll said she doesn’t expect that to happen.

Penelop-I will never get over it. No one ever gets over the loss of a child. I will get through it, but never over it. As far as I am concerned it was not an accident, it was a crash caused by carelessness that cost my beautiful daughter who I love very much her life. She left behind a brother who she was very close to and an expectant sister, who has given birth to a son that will never get to meet his Aunt Heidi.How could we get over this!

Has it ever been figured out just why he was in the wrong lane. Does he know what happened or does his wife know why he went into the other lane. Did he fall asleep, reaching for something, on a cell phone, to involved in conversation, just what ? Something made him go into the wrong lane, but what ? ? ? It might make a difference in if he should be driving again or not.

IWanttoknow: Why a Latino gets put in the hoosegow and the Americano' get a 'free outofjail' card? I wish the Latino would not have run away but stay and take the punishment like the recent 'hit & killed' ped. in North Bend or Dr. Faxel. I totally agree with "Baby Boomer". I've also wondered if the people who so loudly rant about not being able to EVER get on with their lives, aren't using this as a focus point for themselves. Get past it. Don't forget Heidi, but don't let this tragic accident (and remember it WAS an accident) be the focus of your life forever. It's over!

How can anyone think that her family can move on with their life? This young lady, who will never get a chance to live the best days of her life, dies because someone is driving careless, and you think a $720 fine is good enough? Get real people! If this was your child or sister you would want more then a $720 fine. I'm not saying hang the guy, if this was my daughter I would be considering it, but the guy is a eye doctor. Make the guy do a mess of free hours of service to the poor who cant afford eye treatment.

It is NOT against the law. If you cross the center line while driving carelessly and kill somebody, it is NOT against the law. You will get a ticket. If you are involved in an accident that you caused by driving carelessly and cross the center line and hit somebody head on on kill them, just use this case as your legal precedent.

I'm not sure I agree with any one on this one. Yep, he has to live with the fact he caused a young persons death, but so do a lot of people in prison. The one's who actually feel remorse. But that make 2 fatalities on our roads/streets this year, that no one is being actually punished for. A $750. fine is nothing. I agree that there are accidents, but this one goes a bit overboard for me. Just like the French people in the cross walk. OK everyone, go ahead, hit people in the cross walk and it's ok. If you "accidently" kill someone because you were negligent, that's ok too, because you have to live with it. HHHMMMMM. I really don't get it.

You cross the center line and you are legally responsible for any damages and deaths that take place. Once again the legal system does not see fit to punish drivers who commit negligent acts. Look for more carnage and little if any prosecution. If we had done this with drunk driving, we would still be having a lot of people killed or injured due to DUI. Laws need to be enforced when a genuine public safety issue is at stake. Right now we have too many bad drivers out there and they need to get the full load of judgment, both to punish them severely as well as send a message to others behind the wheel that you had better take care of your business or else!

I agree. I think he's been through and will go through enough just knowing that he caused a death. And sitting in jail would not bring her back or make it all go away. It was an accident, that's why it's called an accident.

This whole thing is such a tragedy all the way around. The man admitted to carless driving, and he has to live with the guilt of knowing his action is directly responsible for the death of another person. That in itself is a severe never ending punishement.

A Jail sentence for an accident of this nature seems un warranted based off the information presented.
