Coos Bay city manager threatens mayor

COOS BAY - Coos Bay Mayor Jeff McKeown has called a special meeting to discuss the performance of the city’s manager, Chuck Freeman. McKeown would not say why he wants to talk about Freeman, but at least one councilor suggested it is to fire him.

McKeown made his announcement at the end of a special meeting Monday night to consider a city gas tax and an agreement with the South Coast Development Council. McKeown scheduled a meeting with an executive session to evaluate Freeman’s performance for Wednesday at City Hall.

Freeman objected in front of the council. He told the council he wanted to be present for the discussion, but would be out of town that day for family issues.

McKeown initially backed down, saying they could meet Monday, Sept. 28.

Freeman also insisted the discussion take place in an open meeting.

“If you are talking about me, it’s not going to be in executive session,” Freeman said.

Confrontation

Once the meeting ended and all councilors left, Freeman confronted McKeown.

He told the mayor not to be “f---ing with me.”

“That’s real nice Chuck,” McKeown responded.

Freeman went on, telling McKeown he would give him more heartburn than Janell Howard, the city’s former finance director. Howard filed a lawsuit against the city last week alleging wrongful termination, after Freeman fired her a year ago.

“I hope you are ready,” Freeman said.

McKeown was silent.

As Freeman left the room, McKeown said to himself, “It’s not always fun being mayor.”

Morning reaction

This morning, McKeown said, he officially rescheduled the meeting to take place at 6 p.m. Wednesday. He consulted with the chief lawyer of the city’s insurance carrier, the League of Oregon Cities and the city attorney before scheduling the meeting.

“After his comments to me, we moved the meeting back to Wednesday,” McKeown said. “We are going to be reviewing his job performance.”

Freeman said he’s leaving for Washington state at noon Wednesday to take care of some family issues and he won’t be changing his plans. He said he’d participate via telephone conferencing and possibly have his lawyer present.

This morning, Freeman said he didn’t remember what he said Monday night to McKeown.

“Emotions run high in these things,” he said.

McKeown wouldn’t say whether he plans to consider firing Freeman, but the city manager said there is no doubt in his mind that’s what will happen.

“The mayor has been threatening my job since January and I have it well documented,” he said.

Freeman suggested the city council should review state and federal whistle-blower statutes. He didn’t explain the comment.

Oregon public meetings law allows an employee to request an open hearing of his job performance, though he doesn’t have the right to postpone the hearing to attend or to permit an attorney to attend.

Potential costs

Councilor Stephanie Kramer spoke earlier in the meeting about Freeman’s accomplishments and raised the prospect of termination.

“... We are in the midst of losing our city manager whether it is voluntary or not,” she said.

She also talked about the consequences of firing Freeman, whose contract includes a buyout clause.

“If the city terminates the city manager, the taxpayers will be responsible for approximately $170,000,” she said.

The contract was not available at press time.

[Acting city manager Rodger Craddock has since said the city paid Freeman $128,000 to buy out his contract.]

Freeman and McKeown have locked horns before. When the Bay Area Chamber of Commerce decided to end its agreement to run the city’s visitor information center in July, McKeown and Freeman had a disagreement. According to a letter from Freeman to the City Council, McKeown accused the city manager of orchestrating a breakdown of relations with the chamber. Freeman also wrote that McKeown told him he doesn’t trust him.

McKeown argued it was poor communication, not a lack of trust. He’d gone so far as to contract with a League of Oregon Cities facilitator to help councilors to communicate better.

Other troubles

But Freeman’s trustworthiness was put into question at Monday’s meeting regarding another of the city’s community partners. SCDC executive director Sandra Messerle told the council that Freeman had told her the Urban Renewal Agency had voided its $25,000 contract with the SCDC at the Sept. 16, 2008, agency meeting.

McKeown requested copies of the minutes from that meeting, which showed no indication of such a motion.

After the meeting, Freeman suggested Messerle had confused the September meeting with another one. He said the Urban Renewal Agency had removed the payments during its budget hearing for the 2008-09 fiscal year in spring 2008. Minutes of that meeting were not provided during Monday’s meeting.

After McKeown scheduled the executive session, Freeman argued the record would support his case that the agency voided the contract.

WOW! So the severance package was okay to part with in light of the economy? I wish my ego or pride was worth that much of other people's money. Is the mayor micro-managing? Is that why we continue to jettison city managers? Why was Chuck Freeman so angry that he'd let words fly in public?

This is all just dumb. I feel dumb and I hope everyone who pays taxes feels dumb too. If you can't get past something like this and chose to throw away over $100,000.00 dollars of tax payer's money then maybe it's time for us to find a new mayor! WOW!

It sounds like two men behaving badly. I wish it could be all straightened out but it doesn't read like that. It seems the mayor is going to press ahead to make this situation worse.

The reporter was standing right next to freeman when he made the comments. It clearly demonostrates a threat. Stinks when you are caught red handed. Agree with the businessman. How many of you tell your boss things like and still stay employed. Also, you think the mayor is the first one, ask Councilor's Melton and Joanie and see what their reaction is to Mr Freeman's abrasive behavior and control tactics. You need to look at both sides of the issue not just one.

I agree with your statement of "If it ain't broke, dont fix it." Thats the only thing I agree on. See, us wealthy Washintonians and Californians bring in more money for the city. If you had taken an economics in your wonderful, untouched town of North Band/Coos Bay you would know this. If you want all the "New People" to leave then we might as well take all of these....... oh what are they call...........tourists with us.

I don't think issues are caused by newcomers/foreigners but by sensationalism in our media. It goes on all over the country - making huge issues out of a common practice. That of an employer trying to run an employee out after a disagreement. I also voted for the Dr. and not Jeff because I felt Jeff was only looking out for himself. I also do not trust Chuck but he is attempting to do his job. Why has this Newspaper never done a story on the History of City Managers in Coos Bay? Why not do an ivestigative story and interview all the masses that have come and gone and ask them WHY? What they felt was the real reason. Mr. Freeman exposed Jeff's bullying ways awhile ago in the press and Jeff said it was communication issues, it seems Jeff is always the one with the problem. I've known Jeff a long time, he was in my little brother's class of 1968, Marshfield High School, his dad, Joe McKeown was on many boards around here including Western Bank where my Mom worked for over 30 years, we don't always see eye-to-eye, but, this time I think he is trying to do the right thing, Chuck doesn't appear to have Jeff's education, plus, what's all of that stuff about Walla Walla? Chuck is better off going on-down-the- road.

I did not vote for McKeown, but I must say I support him on this one. Mr. Freeman isn't trying to change things to better our community -he's controlling and narcissistic. He has and will crush anyone who gets in his way. The only reason he is pulling this now is because he wants the severance package so he can move on to wherever. Last I looked, city managers work for the mayor and city council, not the other way around. Freeman made some statements that he could not back up and others that are cryptic according to this article. That's a minus on him. We already know McKeown is a local good ol' boy type so he's no angel in my eyes either.


Last election I voted for the doctor who ran against McKeown and urged others to not re-elect incumbents. Now the taxpayers are on the hook for all sorts of liabilities it appears but hey, it was the majority of taxpayers that voted to continue this mess so they get no sympathy from me. Let 'em get hit hard in the pocketbook and next election maybe they will pay more attention. Somehow I doubt it.

Enough of this Po-Dunk small town back door dealing. You have every right to defend yourself. You have been obstructed from doing your job by borderline fraudulent acts repeatedly. It is time that these clowns are exposed for who & what they are.

Have you even looked up the word "threat" in the dictionary? You are so hurting for a story you make it up. A threat is "intention to cause, inflict pain or injury". Let me guess that the Editor, no less, chose this word for your headline? The newspaper should be careful how far they go making up story lines,they too could be involved in this mess. I say Kudo's Mr Freeman if you in fact said it I can only imagine how many people would want to say it too.

Why does this town keep electing these long established cronies? I guess we deserve what we get. If you the average citizen do not vote, you accept the slate of the Chamber and or the World Newspaper. I think a good approach might be to elect those who we have not heard of, then at least we have a 50/50 chance they might be ethical.

McKeown, if you really loved your city, you'd stop this nonsense now. Every boss has had to deal with a difficult employee, most just learn to deal with it until that employee leaves.

Chuck sounds like he's sick of politics in Coos Bay anyway, why don't you just give him the good job reference so he can move on? He was a decent employee before you, and it sounds like he'll be a decent employee after you...

Believe me, we don't live to work, we work to live. So it'd be fitting for you to work on making the environment around you a little more enjoyable. And maybe, just maybe, you'd get a staff that promotes your agenda.

As for Mr. Freeman, Mayor McKeown probably isn't the first jerk you've had to deal with, or the last. They are everywhere. And even worst in small good ol' boy communities.

This is just plain stupid. McKeown feels he needs to RUN everything instead of letting the proper positions do their jobs. Chuck Freeman has really done the best he could with all the negativity from the mayor and some council members. This city doesn't want change and Mr. Freeman was trying to change things so that it would be more pleasing to businesses to move into the community.
