Howard files lawsuit against city

Coos Bay’s former finance director has formally filed a lawsuit against the city and city manager, claiming her free speech rights were violated and that she was wrongfully terminated.
Janell Howard, who now works as a finance director for Brookings, filed suit in a Eugene district court Monday — almost a year after notifying the city through a tort claim that she would sue.
Howard refused to comment this week, and her attorney, Jennifer Middleton of Eugene, was not available to comment.
City Manager Chuck Freeman also was unavailable, and Coos Bay Mayor Jeff McKeown did not want to discuss the lawsuit.
“Since it is a pending litigation, we can’t really discuss it,” McKeown said.
Howard is seeking damages for lost wages and benefits, attorney fees and consequential and compensatory damages. The court would determine those amounts should she win her case.
Howard contends city officials wanted to fire her after she spoke out against the city’s former auditor, Wall & Wall. Howard disputed the company’s request for more money during a 2006 audit, eventually filing a complaint with the Oregon Board of Accountancy.
Freeman suspended her in July of 2007, saying she needed to consult with him first before taking such actions.
After Howard’s lawyer protested, the city expunged the record from her personnel file.
Freeman fired Howard in September, after Walmart staff said the certified public accountant attempted to leave the Coos Bay store without paying for several items. No charges were ever filed. Freeman contended it was a trust issue.
