Howard files lawsuit against city

Coos Bay’s former finance director has formally filed a lawsuit against the city and city manager, claiming her free speech rights were violated and that she was wrongfully terminated.

Janell Howard, who now works as a finance director for Brookings, filed suit in a Eugene district court Monday — almost a year after notifying the city through a tort claim that she would sue.

Howard refused to comment this week, and her attorney, Jennifer Middleton of Eugene, was not available to comment.

City Manager Chuck Freeman also was unavailable, and Coos Bay Mayor Jeff McKeown did not want to discuss the lawsuit.

“Since it is a pending litigation, we can’t really discuss it,” McKeown said.

Howard is seeking damages for lost wages and benefits, attorney fees and consequential and compensatory damages. The court would determine those amounts should she win her case.

Howard contends city officials wanted to fire her after she spoke out against the city’s former auditor, Wall & Wall. Howard disputed the company’s request for more money during a 2006 audit, eventually filing a complaint with the Oregon Board of Accountancy.

Freeman suspended her in July of 2007, saying she needed to consult with him first before taking such actions.

After Howard’s lawyer protested, the city expunged the record from her personnel file.

Freeman fired Howard in September, after Walmart staff said the certified public accountant attempted to leave the Coos Bay store without paying for several items. No charges were ever filed. Freeman contended it was a trust issue.

Nice try. If you aren't charged and aren't convicted, there is no background. You think they run a criminal history check and the story is going to show up? And if they call her former employer and they say anything derogatory...another lawsuit. I'm not saying she's wrong or right, but some people need to think about what they say before they open their keyboard. A little common sense goes a long way!

The DA dropped the charge. No Guilt. I am sure Mayor Mc Cheese had somthing to do with this.

The fact of the matter is she stole from Walmart. Some of you have the same problem as half the population. Some of you overlook the obvious. Howard broke the law. Stealing, whether large or small, is still stealing. She got caught and was dealt with accordingly based on her actions. What blows me away is Brookings hired her. Nice background check.

I am just glad she is gone. I don't think she deserves to win a lawsuit. She just seemed to cause a lot of problems while she was here. Good luck to Brookings!

You are right Mr E -we do have enough corrupt, lazy people here. However Janell was not one of them. She was extremely hard working and she exposed the corrupt people you are talking about. Mr. Freeman felt threatened by her so he kicked her to the curb when she was down. Yet everyone blames McKeown for conspiracy...

I agree with Action J. and Mr. E on this. According to Howard everyone else (including Administration, Legal Counsel, Security Guards, Grocery Clerks, Insurance Attorneys, Auditors, and Council) is wrong except her. After three years she has to move on at some point, (and hopefully stays away from here.) Also, hopefully Fred Meyers in Brookings has their security cameras in working order.

Hey"orecoast007", the only reason Wal Mart didn't press charges was the dollar amount that was taken. The best part of it was Ms Howard admitted to taking the items. The bigger issue here is she handled 54 million of tax payers dollars, take your small mind and move to California. Mr Freeman would have been wrong had he kept her on handling the Cities Finances when the woman could not be trusted. Not a real fan of this Cities Politics but the law is the law and facts are facts, this is one time I agree with City Hall.

Janell, Since there were never no charges filed in the Wal Mart incident, Mr. Freeman had no right to fire you. I say "Go get em". Heck, our city council can't even play well together....

I hope this woman takes a hike and goes on with her life. I'm sorry, she was a do-nothing employee AND a thief, so good riddance.

We have enough corrupt, lazy people in this city. We don't need to reward one for their ill deeds, especially in this economy.
