'Missing mom' defends ex-husband

COQUILLE - It wasn't exactly a family reunion, but the arraignment of her former husband, Fred Cozad, on criminal mistreatment charges was enough to bring Daveda Cozad out of the woodwork.

"I'm that missing mom," the 48-year-old said. "I lost my memory. I didn't know my kids. I didn't know my whole family."

Cozad's hearing Tuesday was the first Daveda Cozad attended in either her son, murder suspect Henry Cozad, or ex-husband's cases, as she said she suffers from memory loss.

That afternoon Coos County Circuit Judge Michael Gillespie arraigned 61-year-old Fred Cozad on criminal mistreatment based on the year leading up to and the day of Linda Foley's death in March. Henry and Fred Cozad lived together with Foley in their Bunker Hill home.

According to a statement read by the judge, Fred Cozad "having assumed the care, custody and responsibility for the supervision of Henry Cozad, did unlawfully and knowingly withhold necessary and adequate physical care from Henry Cozad."

Today, District Attorney R. Paul Frasier said he could not get into the details of the case. However, criminal mistreatment could refer to a parent or guardian beating a child, or not providing sufficient food or medical care.

"Those are the type of things we are talking about," Frasier said.

 Although Henry still faces the murder charge, the DA is pursuing an involuntary commitment for the teen, who has a mental defect identified as mental retardation with moderate autism. On June 10 and 12 a judge will determine whether the 18-year-old should be unconditionally released, handed over to a guardian or sent to a secure mental facility for at least a year.

A neighbor and Daveda Cozad said they feel the charge against Fred Cozad is bogus.

"I just think it's harassment because they can't prosecute Henry, so they're taking it out on Fred," said friend and neighbor Ray Stitt.

Daveda Cozad said Foley wasn't a good housekeeper, but her former husband was giving their son his medication.

"I've seen that house. Linda didn't clean that house. She wouldn't," Daveda Cozad said.

She went on to say that she planned to cause Frasier problems, but wouldn't describe what she meant.

"I'm going to put a kink in their style," Daveda Cozad said. "I think Henry's getting the shaft for something he didn't do."

The Portland resident believes her son is innocent because he's always shied away from the sight of blood. Therefore he couldn't have attacked Foley, whose battered, bloody body was found by officers on March 12.

"Henry sees blood and he runs. Everybody knows that - everybody who knows Henry," she noted.

Dressed in blue jeans, a teal button-down shirt, and a ear-mounted cell phone  attached to his ear, Fred Cozad stood alone in front of Judge Gillespie. He said he understood the charge, but made no other comment, beyond asking if he could go.

The judge entered a not-guilty plea and appointed Coquille Attorney Matthew Muenchrath for Cozad's defense. He will reappear in court for a plea change hearing June 29 and could face up to five years in prison if convicted.

Fred Cozad said he wouldn't comment on the case until he spoke with his lawyer.

To Linda's family: As hard as it is, forgive this woman, it will be easier than to hate her, shes insignificant.
To DA Frasier: Drop this matter with Henrys dad, focus on whats the best placement for Henry, then let these families and our community heal.

Let's just say that no one ever pulled the wool over my eyes.

The court should make this man answer for the way he's neglected ALL of his children. It's too bad that someone has had to DIE for the system to get involved.

I think the adults here have forgotten there are laws that protect the way children and people with MRDD are treated and cared for. The state should have been involved years ago!

So, Sister in Law... Stop making excuses. Everything will soon be on display for everyone to see...

The Cozad's of course, will be biased. They actually believe in their way of life. But Linda - she had a family, many of which are still here, and they deserve justice for the loss of her life. Everyone would be better off if they could remember that... regardless of circumstance.

I agree. How can one who claims to suffer memory loss be of any use in this case. Hopefully, no one will put any stock in what she says. And as for Mr. Cozad, notice how much nicer he looked in court! Nothing like the other photos of when he was at home. And a blue tooth in his ear? It's a wonder that the judge didn't notice that and make him take it off. How disrespectful.

It is just sad. The entire situation is sad. To bad someone had to die to get the 'missing mom' out of the woodwork. Maybe since she remembered the condition of the house, she should've remembered that she had a son, who obviously was in need of help that he didn't get before someone was hurt. Just a sad, sad situation.

WOW,For a MOM that has lost her memory she sure is remembering alot...laughing out loud..well i can say that Linda was always a good housekeeper and that house was a mess before linda ever moved in.I cant believe this family is still bashing Linda.Do you people understand that we as her Family would appreciate it if it would stop..We have stayed out of the court hearings and any other action being taken but i think it is time we get involved!!!! Also for a Mother whom was never around how would she no anything about the situation in the home give me a break

If she suffers from memory loss, tell me how can she "remember" what shape the house was in! And where has she been all this time? This poor woman was murdered by the hands of this boy, I agree he is sick and may not of known what he had done, but, this lady should not be speaking the way she is of Ms. Foley, it is just not right! God rest her soul.
