Man gets jail in Coquille assault case

A young man accused of beating a 51-year-old Coquille man on a Coquille street will spend three months in the Coos County jail.

During a plea change hearing earlier this week in Judge Richard Barron's courtroom, Aaron J. Pfannenstiel, 20, pleaded guilty to reduced charges through a deal with the Coos County District Attorney's Office.

For his charges of third-degree assault, reckless endangering and resisting arrest stemming from the April incident, the Roseburg resident also will be put on three years  probation.

Pfannenstiel and a 15-year-old boy attacked Howard "Dale" Roberts on April 16, after the man and his wife, Judi, crossed in front of a car driven by the two youngsters. They were angry the couple was slow. They honked and flipped off the Roberts, who returned the rude gesture. Shortly after, the two assaulted Roberts, who suffered a spiral fracture to his right leg. He went to Coquille Valley Hospital where he underwent surgery.

Pfannenstiel and his partner faced identical charges of two counts of third-degree assault, recklessly endangering another, failure to appear, two counts of menacing and resisting arrest. However, Deputy District Attorney Karen McClintock, who is handling the case, said she pursued only one charge of third-degree assault based on the theory that Pfannenstiel hurt Roberts with the aid of another person.

She added that the younger boy, who is being held in the Coos County Juvenile Department, pleaded not guilty and is scheduled for trial on June 26.

"We have a strong case against (the boy). I'm not worried about it," McClintock said.

Pfannenstiel's sentence, she said, does not include credit for time served.

She went on to say the court will hold a special restitution hearing in August and is waiting to determine the full cost of Roberts' medical bills.

"This will give us time to do that," McClintock said.

And what do the Multnomah County Jail and the state have to do with the COUNTY jail? The federal timber dollars that supported the jail and other county offices is drying up. That is why not enough beds. Not a scare tactic, just the truth.

To JSpicher: They are already using a bed and have been since this has happened so that is not the case here! The problem is as I have said before, is for some reason the D.A. plea bargains down the more serious charges on almost all cases. You can see this if you look at the sentencings and dismissles in the paper. It is a joke and it shows these jerks that they can get away with just about anything and they do.

JSPICHER, there are enough beds, they just aren't using them for political tactics to get more money from taxpayers. Remember about 5 yrs back when they were going to release a bunch of prisoners. At that same time we were bidding on the Lakeview prison. Only a few people from a Portland jail were released. People need to get a clue and the State needs to spend our tax dollars more wisely,and quit having lunch on my buck.

So we just let everyone break the law and blame it on economics.

The laws are in place. The Police catch the suspect. He has his day in court. The DA is hired and charged with the prosecution of the case.

There's money for all those steps but no place or no money to hold the convitcted for a sentence?

Then why spend all the money going through such a process?

Either just stop arresting law breakers or hang 'em.

Either way, your economic troubles are over.

Seems to me the problem still lies, and I have stated it before, we are not holding people accountable for their actions. Actions which are illegal. Actions that should qualify for more than a few months jail time.

If someone would just make the attempt to try the case.

There is no where to put these people... the state is planning on axing yet 4 more jails in Oregon because they've been forced to cut 30% of their costs. You can't have your cake (lower taxes) and eat it too (expect there to be enough space in the jails after cutting funding by 30%).

3 months is not enough time for this creep to be punished for what he did.
He needs some real time and work duty to make hime realize one cannot beat up on older people. The younger one needs to be put away and do a lot of community service too with a sign hung around his neck that says I assault old people and am learning my lesson.
Both of these creeps need anger managemnet classes. We will probably hear about the older one in the future as I do not think he will ever be responsible for his actions, not enough between the ears.

That's a mighty short sentence for a violent crime. I guess the criminally inclined will get the message being delivered that punishment isn't much in these parts. Better be ready to protect yourself folks.

I see the Deputy D.A. is learning well from Frasier! Heck Dale Roberts won't even be healed up from the beating he received from these idiots by the time they get out of jail! He will still more than likely have his cast on unable to walk while these creeps dance right on out of CCJ! Truthteller, I wish someone in D.A. land could tell us taxpayers WHAT is wrong with this picture!
