Oregon House: No smoking when kids are in the car

SALEM - The Oregon House voted Wednesday to outlaw smoking in cars when anybody 16 or younger is riding along despite some lawmakers' concerns it would burden already stretched local police departments.

Backers of the bill said the state needs to protect children from secondhand smoke - and send a message to parents to stub out their smokes before getting into a car with their kids.

"In fact, this is a form of child abuse," Rep. Mitch Greenlick, D-Portland, said of those who smoke in vehicles with children on board.

The bill passed 35-25 over the objections of lawmakers who said police already have their hands full trying to catch criminals.

"There are drug mules going by and burglaries and domestic abuse going on," said Rep. Vicki Berger, R-Salem. "I want our police officers out there dealing with real crimes, not bad parenting."

Representatives of several police departments said Wednesday that while the proposed smoking ban wouldn't be all that difficult to enforce, strapped police agencies would have to keep giving top priority to avoiding serious traffic accidents and fighting major crime.

"The challenge in Eugene is our relatively low number of police officers," said police spokeswoman Melinda Kletzok. "High priority calls that involve protecting people's life and safety are going to take precedence."

Medford Police Sgt. Greg Lemhouse said police officers would have wide latitude to pull someone over if it appeared children 16 and younger were in a smoke-filled car.

"It wouldn't be difficult to enforce, but it wouldn't be our top priority," Lemhouse said. "A traffic team needs to focus on the highest priority - trying to save lives by preventing risky driving behavior."

The House bill, which now goes to the Senate, would impose a maximum $90 fine for a first offense; $180 for a second one and $360 for a third.

Four other states - Arkansas, California, Louisiana and Maine - have similar laws.

The chief sponsor of the bill, state Rep. Chuck Riley, said it is time for Oregon to join the other states because some people continue to subject children to smoking in vehicles despite the documented ill health effects of secondhand smoke.

There are no statewide statistics on how much that happens, the Hillsboro Democrat said.

"But on the freeway and on the highways, at least once a week I see kids strapped into their car seats with the vehicle full of smoke," Riley said.

During Wednesday's House debate, several lawmakers said it in some cases it would be difficult for police officers to tell whether the occupants in a vehicle are 16 or under.

Bend Police Department Sgt. Chris Carney said police officers likely would have to use a "lot of discretion" in deciding whether to pull someone over.

"Obviously, if you see a kid in a car seat and the parent smoking, that would make it a little easier," Carney said. "It would have to be a case-by-case basis."

I'm 52 years old, back when I was a child, my dad smoked around me all the time. I have no signs of cancer or anything else. Can't make enough money off of the drunks driving around, or the idiots that can't drive and talk on the phone, so give me yet one more law. I never smoked around my kids or grandkids when I was a smoker. Quit it, just quit it, I'm tired of all these laws that tell me how I CAN'T live my life. I am sick and tired of it. when is enough ENOUGH!?

Some poeple do not read the papers, or keep up with the times. One of the post said that there should be a law to stop people from smoking in public places. There is . It went into effect this year. But on the other hand, I think they should outlaw bad breath. Some of these people's breath is bad enough to gag a dog on a gut wagon.

Wow I can't understand the stupidity of some people. How UNFAIR for a child who has to sit in a confined car or house for that matter and smell the stinky stench of cigerattes because their parents dont have the courtesy to not smoke around them. I was raised around my parents smoking, which made it VERY easy for me to choose not to be like them. I hated it growing up. Not only does it smell bad and make it hard for you to breath, but it makes your clothing stink, etc. Smokers should act a little more grown up about this and do whats RIGHT for their children! These kids nowadays have it hard enough in this world. Quit complaining and just smoke outside and away from them!!!

It is rediculous that this bill went to the house - and more so that it got passed. Does anyone see that we are on a slippery slope. Smoking is stupid and unhealthy - OK, I get it. But legislating that people cannot smoke in a car with children under the age of 16 is stupid. How do they enforce this? Are we going to have to get ID's for our children that are 16-18 for them to hand over to the officer when he pulls us over for smoking in the car?

Next thing you know there's going to be cameras in our homes making sure we're not eating salt or having unsafe sex - both of which are equally as bad for us as smoking.

I care about kids, even if their own parents don't. Yes, in this day and age, I guess that's really really rare that someone might think or be concerned with someone other than themselves.

I'm a smoker. Yes, a nasty habit, but I enjoy it. I'm also a considerate smoker. I don't like subjecting my carcinogens onto other people. I know that cigarette smoke is harmful.

Kids have the right not to be subjected to cigarette smoke. Unfortunately, kids cannot choose their parents.

but never, ever around anyone. I know, closet smoker. My husband never saw me smoke nor did my children or my grandchildren. I agree with non smoker. If people (smokers) took other people’s rights into consideration (smoking at the entrance of a public building) or cared more about the health and well being of their children the government would not have to step in.
By the way, thanks to the new cig tax, smoked for years has now decided not to let the government suck up more of my hard earned money, I quit 2 months ago.

What will be next....fast food only with a dr. okay, no salt in restraunts, deep fat frying is out, every family has to join a gym or have one of those step devices so that lawmakers know that they are excercizing, maybe inplant a chip so that they can tell how much you drink, how much fat each day, calories, etc...put a gps with that and they have you all covered. I am a non-smoker and have little children. I think exposing your kids to smoking is bad and agree with most of the parents and non-smokers view on here. HOWEVER, the laws seem to be going farther and farther. What's next? We can’t enforce the laws against “real criminals” now so we want to add more laws infringing on a persons rights. I agree, it is not a healthy situation but we can’t continue to make laws to save the world that can not be reasonable enforced. Getting the illicit drugs off the street is much more important! No smoking in the cars? Though the concept of the legislation has good intent, i believe it will make things worse! Most likely, if the person is smoking in the car with their kid, they have little concern for their kids nor their own life anywho, and the probably smoke in the house with the kid there too!! I think this is a crock law....I see 16 yr. old drivers with a turck/car load of friends with them...they just got their licens and know they are not allowed to have friends with them...the cops can't tell the ages of new drivers how are they going to tell the ages when some one lights one up with people in their cars/trucks?!?!

Thank goodness they are banning this. My brother and I both have severe asthma and we were victims of two chain smoking parents. They have since quit, however, they regret exposing us to their second hand smoke throughout our childhood (especially those days in the car – WITH THE WINDOWS ROLLED UP). There is no family history of asthma and we were the only kids in our extended family around second smoke. Yes, must be TOTAL coincidence …And, to the person commenting that kids grow up now with a sense of entitlement?!?? My apologies for feeling entitled to healthy lungs and life without an inhaler. I don't think that's too much to ask for.

This is NOT a matter of the state. It saddens me that people fall for such things implemented by our government. Sure, there is plenty of validity in the details of this specific law BUT... The abundance of laws such as this solves no issue of social concern; these laws merley wean the state out of the social domain and edges it into the privacy of our own lives. These same children will soon wonder how their forebearers called this a FREE COUNTRY.

This entire bill is a waste of the State's time. We have serious pressing issues that need to be dealt with now!

Our schools are under-funded, our jails are over crowded, our police forces are spread so thin that they can only respond to major incidents, we have some of the highest unemployment since the recession of the 80's and our lawmakers are focusing on smoking in cars.

Thank goodness someone is looking out for the welfare of our innocent little ones. Anybody so selfish and stupid to smoke in an enclosed area with children present should get more than a fine. What is this but child abuse? With the price of cigarettes maybe this will not be such a problem. Besides the danger of smoking and driving it may just save some little one a lifetime of illness. But the rude smokers out there probably don't see it that way. Hope it is enforced to the highest degree.

I know--we can cite parents with child abuse if their kid gets a cavity in a tooth! I'm trying to be as ridiculous as these lawmakers. I'm definitely on the smokers' side, even though I have never smoked in my life (and neither one of my kids ever had a cavity). This is not about smoker’s rights…it IS about protecting children!

Like Christine, I grew up with a father who smoked in the car with the windows rolled up, as well as, in the house. I was diagnosed with asthma at a very early age that was attributed to my father’s smoking. It is a health issue that is still being treated today.

Personally, I consider anyone smoking with children in the car (or, even in their own home) guilty of child abuse.

This type of enforcement has been implemented before: cellphone use, seat belts, kids in safety seats that weigh less than a certain amount, etc. It is all well and good, but it brings up a very valid point: how does an officer determine compliance WITHOUT making an enforcement stop for a violation that as yet does not exist? If I remember correctly, reasonable cause must exist; just saying someone looks under 16 does not make it legal.

Smokers again. Why don't they do something with all the drinkers in the state. Like, first time you are proven guilty of DUII, one year in jail, minimum, NO exceptions. But then they can't do that, THEY would be in jail all the time.
