Prosecutors' plans to send murder suspect Henry L. Cozad to Salem for a mental evaluation are on hold. The Oregon State Hospital doesn't have a place to put him.

On Monday, Judge Martin Stone approved a motion to send the 18-year-old man for an up to 30-day evaluation to determine his competency for prosecution.

However, Coos County District Attorney R. Paul Frasier said the hospital won't be able to take the teen for at least another three weeks, and then only for a four- or five-hour assessment.

Last week Coos County sheriff's deputies arrested the teen on a murder charge in the death of Linda Foley, his father's girlfriend. The three shared a home in Bunker Hill. The DA said Cozad suffers from mental disabilities that he and the man's family described as severe autism.

Instead of waiting to send Cozad to Salem, public defenders Carole Hamilton and John Meynink are trying to get a psychologist or psychiatrist to evaluate him while he is being held at the Coos County jail.

"What we're trying to do is circumvent the whole thing," Frasier said.

If an evaluator determines Cozad can't aid and assist in his own defense, a circuit court judge will be asked to commit the teen to the state hospital for treatment in hope that one day he will. Such a commitment could last up to three years, Frasier said.

"That's what I'm worried about," the DA said.

If the hospital determines he will never be able to aid and assist, Cozad could be sent back to Coos County. If the judge agrees with the evaluation, then the case would be dismissed. Should that happen, without some other mechanism to keep Cozad under supervision, the DA said, he could be released back into the community "like nothing ever happened."

 "In this type of case it is very frustrating," Frasier said.

The DA plans to look into the possibility of a civil commitment for Cozad if a dismissal of this type occurs.

The family did not need respit care as we all took care of henry and did not need it and we do now how to take care of this child

i am part of that family do to my father and i know that henry could not do any thing like that to linda and i am sorry that it happened but i really dont lthink that he did it and even though my fathers side of my family dont talk to me i will defend poor henry he always gave me huggs and never once tried to hurt me even when he frist met me so please dont talk about him like he did the crime cause i dont beleave that he did

LInda's Family would like to say thank you both for reconizing Linda and what was done to her,Yes are Family is devastated,Her oldest son is on his way here so show the proper respects to his mother,we all just wish that all this wasnt just about Henry and people relize Linda left 5 wonderful children when her life was taken from her,we also dont believe Henry will get the help he needs at home. Thanks again,Linda's children and family

I realize this kid has problems, and they need to find him some kind of help. Staying home is not going to help, he and his family need professional help. Dad apparantly needs help to learn to control him and not just let him "run free". But actually the most important thing we can't forget, is someone lost their life. I am sure she had family too, that will miss her.

By not providing the help this child needs, a great disservice has been done to him, the victim and the whole community. There seems to be no help for the mentally impaired in this area, short of incarceration. It is either do nothing, or remove them from their home and lock them up (or shoot them). We need better alternatives in this community. I can't imagine the hell this child is now going through. It is inhumane.

this reporting brought me to tears. so heartbreaking. I am praying for the family and for Henry and hope that you all are doing so as well. Carole is a wonderful attorney, hopefully she will be able to get Henry the help and care that he needs.

Oh, yeah, the child is the only one who lost. The woman who was killed didn't lose anything... just her life. But who cares?
We can't make a person who doesn't understand the real world feel bad... let's just give him back to his daddy, and let him live in Bunker Hill in peace!

Regarding the article... this is absurd, but not surprising. A family member of mine had to nearly kill someone before the state finally took him in, in spite of years of pleas and insane behavior.
