COQUILLE - An 18-year-old murder suspect will spend the next few weeks at the Oregon State Hospital for a mental health evaluation to determine his ability to aid and assist in his own defense.

Until then no other hearings will be set for Henry L. Cozad of Coos Bay, said Judge Martin Stone at the teen's arraignment on Monday afternoon.

The teen is accused of murdering 59-year-old Linda S. Foley on Thursday at the home they shared with his father in Bunker Hill. The Coos County District Attorney's Office has said the suspect has severe mental health disabilities considered to be severe autism.

Via a live video conference broadcast into Stone's courtroom, Cozad sat with public defenders Carole Hamilton and John Meynink for the arraignment. Dressed in an orange jail jumpsuit, the teen was unshackled through the hearing and at one point offered his attorneys sips of a Dr. Pepper he held in his hand. Family members and friends of Cozad's family sat in the courtroom.

Hamilton's office filed a motion to commit Cozad to the state hospital in Salem for the evaluation and received immediate approval from District Attorney R. Paul Frasier, who is also interested in learning more about the defendant's mental state before proceeding with the case. However, the DA balked when Hamilton mentioned Cozad's father, Fred, requested that morning to release the teen into the community and have him evaluated locally. Frasier said he did not feel that would be a wise decision.

"I'm opposed to him being out in the community at this point," Frasier said.

Cozad, he said later, is 6 feet ,1 inch tall and weighs about 220 pounds.

He referred to a case last year, in which an instructional aide filed assault charges against the teen after being strangled while working with Cozad via the South Coast Education Service District's life skills program. The attack left the man with permanent spinal cord damage, a Coos County Juvenile Department victim impact statement said.

Stone set $1.5 million bail for Cozad and signed the defense's order to commit him to the state hospital.

Frasier said Cozad will be sent within the next seven days to Salem, and the hospital has 30 days from his arrival to complete the evaluation.

The evaluation is incredibly important to the prosecution, the DA said, because if the defendant isn't competent enough to assist in his own defense, the case can be tossed out.

"If I had to guess, I'm afraid it's going to say he never will be able to," Frasier said.

If Cozad is found to be competent, without mental disease or defect and is convicted, he could face life in prison, with a 25-year-minimum sentence for the Measure 11 crime, Frasier said. If he's found guilty but insane, he could be put into the state hospital for the remainder of his life, subject to the will of a psychiatric sentencing review board. If Cozad is unable to assist in his own defense, the DA said he likely will pursue a civil commitment.

The defendant is being held in a cell in the jail booking area. Frasier said jailers are keeping him calm and busy watching Disney children's movies and drinking Dr. Pepper, which the DA purchased himself because it is reportedly the teen's favorite drink. Cozad hasn't been out of control while in custody, Frasier added.

"It's just easier for the jail," Frasier said.

That's also why Cozad didn't appear in court for the arraignment, the DA said. The teen might have found a belly chain and shackles upsetting. He noted that at some point, Cozad will have to appear in a courtroom.

I am the daughter in law of Linda brother. No matter how mental he is he still took a human life. For that he should pay. They was a lot of warning signs that was over looked. So for all of you people that feel sorry for "THE BOY" walk for a while in our shoes. Knowing that the man that took the life of someone you love is watching Disney movies and drinking Dr.Pepper.

The only thing I want is for all of you who say he has autism, to show me how you know? Right now, there are only assumptions being made about this. The news isn't credible enough to make this diagnosis, or the police department, and neither are you. So please, show me where his official diagnosis of autism has been published. There are physical and mental disabilities other than autism. Any child with developmental or mental disabilities can go to a school or class for those disabilities. They do not have to be autistic. Autism is just one of many disabilities. And just because he goes to a school like that does not mean he has autism. He obviously has disabilities, but unless you have actually seen a written doctor's diagnosis backed up by testing, you can't assume it's autism. It has to be diagnosed by a medical professional or educational professional, not the newspaper. Sorry...but you're incorrect.

Senior citizens compete with developmentally disabled. Physically disabled compete for tax dollars with both groups. The three groups even overlap. We love to welcome retired people from other states with their real estate assets; parents of children with disabilities seek us out for our high level of compliance with federal statutes; we have our own history of work related injuries in all of our indiginous industries. Actually, it was your friends at the ACLU that ended up putting all the mental patients on the streets. They contended that their rights were being violated by being confined to an institution. Reagan just happened to be President at the time of the lawsuit. Hopefully, this will encourage you to do your research before repeating left wing dogma.

Too bad we could not help this young man and have gotten him off the streets and into treatment were it not for well meaning left wingers. The law of unintended consequences is often cruel.

The people commenting on this story have no clue about this individual. He is not Autistic, he is severely menatlly retarded and has no idea what he has done. He may be adult size but he is a child mentally. He will not be competent to stand trial and I'm sure he will be sentenced to the State Mental Hospital for the rest of his life. He was receiving guidance from teachers and counseling in school but you can only do so much with someone of this mind frame. Please think before you comment negatively about who may or maynot have been impacting Henry's life because unless you were involved, you have no idea how the professional's dealt with him.

I have to say Brianna, if you would not have made the first comment I wouldn't have made mine. But I am glad there are so many comments here today. It makes me think that our communities do care and want to see the disabled get help. I have to agree with several of the comments that our system has failed this young man. Many of the people involved with this sad story are suffering today.My thoughts and prayers are with the families of Linda. And for the people involved with Henry's future. He does need help. I am really sad he didn't get help when there were charges pressed against him for attacking the Instructional Assistant. Something should have been done then. He absolutely should not be turned back out into the community.

I know that in jail and prison they have tennis courts etc. Do I think that is right? NO.
I do know several children with autism. But whether or not they have a disability does NOT excuse him for the crime. That is why there is a court system to figure out what is the best treatment/punishment for his individual case.
Maybe if something was done after the attack on the teacher/teacher aide this could of been prevented?
Or should we ignore this too because he has autism and let him out in the society with no help or treatment?
