High Court won't hear LNG case

The Oregon Supreme Court has refused to consider an appeal filed by opponents of the proposed liquefied natural gas terminal on Coos Bay’s North Spit.

The appeal argued Coos County needed to consider tsunami zones before approving the LNG terminal’s land-use application. The Land Use Board of Appeals and Appeals Court both disagreed with this thinking and the state Supreme Court followed suit Wednesday.

In a one-page notice, the court simply said it had considered the appeal and denied it. It offered no further explanation for its decision. A court spokesman said such a response is typical for denied appeals.

Although LUBA disagreed with appellants regarding the tsunami issue, it did find fault on other issues, including insufficient wetland mapping and archeological preservation plans. The county couldn’t address those flaws until the tsunami-related appeal ran its course.

Patty Evernden, Coos County's Planning Director, said it probably will be several months before the issues can be reconsidered by the county.

“It’s going to take some time for the Supreme Court, the court of appeals and LUBA to put out their orders and then we will have a set amount of time to hear the remand,” said Evernden.

The Supreme Court spokesman said it will be at least 21 days before lower courts receive a report.

Randy Prince, the Eugene activist who raised the tsunami issue, could not be reached for comment Thursday.

The terminal developer, Jordan Cove Energy Project, considers the risk of tsunamis in its construction plans. It plans to build berms up to 55 feet above sea level around its LNG tanks to protect them from tsunamis.

Guess you forgot or uninformed on the MAIN facts of this California LNG SCAM:

1) LNG is OVER 2 times more expensive then natural gas used by Oregon citizens today.
2) LNG is a air polluter.
3) 400 Oregon property owners will lose 80 foot wide section of their land, just so California can get some gas.
4) LNG INCREASES on dependence on foreign countries (Hostile ones like Russia, Iran, Algeria, etc) for energy needs & will black mail the USA causing HIGH prices increase & EXTREME hardship on ALL USA citizens.

The entire USA needs to become INDEPENDENT of foreign countries & not more dependent on them & if Oregon needs future natural gas, the gas coming from the Rockies would be 1/2 the price of this LNG SCAM! Read up & get educated & you'll say NO too!!!

I can find no real common sense reason.

Any tsunami large enough to breach the north spit and the 58 foot tsunami enclosure would cause so much damage in the Bay Area that any propane explosion would not add significantly. The dunes, themselves, are a result of a very big tsunami which struck the Oregon Coast. There are similar dunes on the coast of Australia and Africa, formed by catastriophic wave action. Look at these areas on satellite maps. You will see that the damaged areas are huge. A hundred foot wall of water with all of that kinetic energy behind it goes far inland.

Environmental impact? I lived near a major propane storage facility for 10 years and never knew it, until someone ruptured a pipeline carrying the stink they put in propane.

Terrorism? Please... the Bush Administrations fear tactics cannot have been so effective that you'd rather have a poor economy with rampant drug use.

This doesnt surprise me in the least,Why would the courts even bother with taking time away to even hear anything that has to do with the southcoast.As far as a tsunami the earthquake that proceeds the wave will probably turn the spit into quicksand and the whole dang spit will disappear.

If a 100 foot tsunami strikes Oregon, the propane leak and explosion will be a minor event compared to the destruction the wave will bring. THINK!!!

Maybe you should file a lawsuit against the subduction zone that will send you that tsunami, instead, for all the good that you are doing.

In the case of a "terror attack" the resulting explosion would take out Empire with all it's meth labs. Thats a plus.

I don't understand what "fried" means. You people act as if Natural Gas is like nuclear power. Natural gas is one of the safest forms of energy and a lot cheaper than electricity. Government Bails out the Crooked banks and then taxes us to pay for it. Then the same Government bans the cutting of timber, one of Oregons Great renewable resources, taking away our jobs. I can understand why an activist in Eugene is against LNG building, he doesn't have to live here with the unemployement rates. But, why is Coos County so against change? Do they realize How much money and jobs LNG would bring into this area. If we don't change, this County is going to die. Without jobs the families will move out. And the only ones left will be the Old Retired people, that don't want to see this Quaint little coastal community change.
