Lawyer: Coquille coach did no wrong

COQUILLE — The lawyer for Coquille High School’s track coach says she is guilty only of showing kindness to an athlete.

Following a court hearing this morning, David Terry of Roseburg criticized the Coquille Police Department, suggesting it rushed its investigation into allegations that Wendi Boutiette had sex with a minor.

“Nothing whatsoever of a physical nature ever occurred,” he said. He predicted the case would end in dismissal or acquittal.

Prosecutor R. Paul Frasier said the charges against Boutiette stem from a one-time incident at some point in 2006. Police arrested Boutiette on Saturday, on charges of second-degree sexual abuse, contributing to the sexual delinquency of a minor and sexual misconduct.

Police have since interviewed at least five teenagers, two of whom claim they had relationships with Boutiette, said police Chief Mark Dannels. Terry, however, said Boutiette had “consensual, intimate, lawful contact” with a former student — an adult she had coached five years earlier. The other alleged victim was an adult co-worker, Terry said.

In court today, Coos County Judge Martin Stone set a preliminary hearing for 8:30 a.m. on March 17. He agreed to release Boutiette from custody as long as she avoids her alleged victim and Coquille School District property.

Terry requested she be allowed to attend school events involving her own children if held outside of Coquille, which Stone allowed as long as she is accompanied by an adult.

Boutiette has coached at Coquille for several years. She first was hired by the district as an assistant coach in the 2002-03 school year. Superintendent Diann Gillaspie said Boutiette became head coach in the 2007-08 school year.

Her contract for the current year wouldn’t go into effect until the season begins, which won’t happen until next week. Rather than recognize the contract, Gillaspie said the district has essentially suspended Boutiette until the legal issue is resolved.

“We will wait until the courts handle this,” she said.

While the majority of sex offenders are men, they do not account for all of them. In an interview this week, Michelle Nicolaus, a forensic interviewer for Children’s Advocacy Program in Coos Bay, said it’s usually only in high-profile cases that women get exposure as sex offenders. Part of the reason women are less likely to face prosecution is because a boy is less likely to report being a victim.

“It’s perceived as cool to have sex,”  Nicolaus said.

When such cases arise, it usually takes a boy confiding in a friend or realizing after the fact that having sex was wrong. That’s when people find out about it.

In the case involving Boutiette, the former student confided in a mentor who passed word  to the school district, Frasier said. The incident allegedly occurred in 2006, when the boy wasn’t yet 18 years old, according to a press release from Frasier’s office. The boy is now an adult.

In the eyes of the state, it doesn’t matter whether the victim is a boy or a girl. The same law applies.

Someone charged with second-degree sexual abuse is accused of having had non-consensual sex. That doesn’t mean the minor was forced into having sex, though.

“A minor can’t legally consent to have sex with an adult,” Frasier said.

If a victim is younger than 16 years old, the state would charge third-degree rape. For cases involving someone younger than 14, it is second-degree rape. And adults who have sex with a child under the age of 12 can be charged with first-degree rape. First-degree rape can also apply for cases involving older victims if sex is forced upon another.

Nicolaus said the psychological impacts are often more severe if the child is younger, the abuse involves violence or the perpetrator is related.

When boys are the victims of sex abuse, they often act out their anger, while a girl would internalize it, said Nicolaus.

Both boys and girls can convince themselves they aren’t victims, in part because the perpetrator grooms them to believe what they are doing is appropriate.

“Teenagers are curious about sex,” Nicolaus said. “But the adult knows it is wrong and shouldn’t take advantage of that interest.”

It's a shame the world newspaper prints everything the cops say. Just look at all the comments to get an idea. Why does the world newspaper feel the need to name anyone and everyone charged with anything by Coos County Law Enforcement. They know they are ruining peoples lives, but it's ok if the cops say so.

The young man told a mentor for what reason who knows. Maybe after all this time he realized it was wrong and needed to tell someone. It is the mentor that alerted the school officials. So this is not a question of hear say. If she is guilty of this conduct then she deserves to be in jail. If not then she will be found innocent. Let's not forget that her children as well as her husband are victims of her actions as well. They now have to live with the backlash of what she has done. She did admit to cheating on her husband. I'm sure their lives are over as they knew then to be.

Nobody ever said that people weren't wrongly accused of things. It DOES happen and I think we all realize that but what you are trying to do is put all the blame on the Coquille Police. It isn't their fault that someone made accusations against this person. They do what they have to do. Investigate and go from there. Paul Frasier also said, he doesn't move forward with things that he doesn't think will go to trial. He is moving forward with it so obviously he thinks there is enough evidence to do so. First of all, this case is not about what the Coquille Police have or have not done in the past. We have a new chief and he has done an excellent job with what he has. As far as her attorney goes, if you want to call blaming the police for what she has chosen to do then yeah, I guess he is great. Like Paul Frasier said, it is what yo do when the facts look bad for your client, blame the police investigation.
As far as the police giving that guy "a broken neck" you obviously do not know all the facts surrounding that case either. I do know all the facts. ALL OF THEM and it WAS NOT the police officers fault!!!!! So before you start condemning the coquille police, maybe you should have all the facts!!!!!

To "Look at the Facts". I agree with you, In the past we did have a screwed up police department, but now, we finally have a good Chief of Police. Evidently you do not know anything about police work. The police don't just go out and arrest people on what one person says. They investigate first. In their investigation they found enough evidence to arrest Wendi and they did, so what is wrong with that. The only problem here, is that the Judge let her back out on the street. Why should the police arrest people when the judge turns around and lets them back out on the street so they can continue whatever they are doing and was arrested for in the first place. Wendi should be in jail NOW.

2. Her attorney is an excellent attorney from Roseburg. I sat on a jury on one of his cases in 1991 and he did a stand up job of showing how the cops screwed up. His client was acquitted.
3. My CHS students know Wendi as a coach and are puzzled by these accusations.
4. Ever since I have lived in Coquille I have witnessed the CPD screw up time after time. They paralyzed a guy during an arrest. One was just busted for theft of evidence. Serious crimes go unsolved. They make a habit of stopping and hassling residents over debatable petty crimes.
Check the records, this is all recorded down at good ol' city hall. After you check that out maybe with all the facts on the table you can see where they may have screwed this one up too.

She was 18...her parents gave their consent...and yes, they are now married and an awesome young couple. This has nothing to do with that. I thought of that very case the other day, that was super hard on Tom King's family, but we crucify the COPS if they don't do anything and if they do. So really no one is ever going to be happy. In the Register Guard she admits to having sexual relationships with two 18yr olds, that hasn't been in The World, it's just crazy to me how the story keeps changing, especially after a lawyer comes on the scene. What a husband, standing by her side in this situation, where she has admitted to the lawyer at least she did have 'contact' with two other young men, of age of course. She is one lucky woman if he stays by her side.
What about the innocent children who will have this information about their mother to live with. Did she think about them at all. Hope she had fun !!!

Mike is GONE and we finally have a new Chief who really cares and knows how to do his job. Chief Dannels is nothing like Mike proved he was. Dannels is the single best thing that has happened to Coquille in years. Great work Chief Dannels and the other police on the force. Don't be discouraged by the negative comments here, those people making the negative towards Chief Dannels and the rest of the Coquille police are just affraid that you are uncovering what THEY have done. Looks like the CPD is bolstering their case with a smear campaign by leaks to the press. If the other two "victims" were an illegal act, then they would also charge her for those crimes, and if not, then it should have never been important to this investigation, and there is no reason to give out that information in a press release, other than to smear her reputation, and of course bolster what is starting to appear to be a weak case of: he said, she said. I might also add that teenage boys have a tendency to brag, sometimes embellish a story, and when called on it, they feel like they are backed into a corner, embarrased around friends,and have to try to back it up, in order to save face, whether it is truthful or not.

I was on Wendi's track team all through school and never once have I gotten any clues towards her being a sexual predator. I know Wendy and she is not the type of person to commit such a crime. This is just ruining her reputation and not to mention her family. Leave her alone. If the incident had really happened, we would have heard about it a long time ago. Secrets are not kept in Coquille. Everyone knows that.

The CPD has done what they are expected to do. Big shocker that the woman's attorney says she is not in the wrong. We'll see how it pans out. The CPD is right to fully investigate and make sure the community youth are protected. I'm sure they enjoy sorting out whether she's an unfaithful wife or a child molester! She would not have been arrested if something serious wasn't going on!

My boys were CHS athletes while Wendi was coaching. They are the same age group as the boy/boys mentioned.I remember her also. Coquille is a small town and I have never heard or seen anything remotely close about this women that would imply such a thing took place.
Also, Coquille PD has a reputation for not using good judgment and are lacking in experience. It wasn't long ago a man was paralyzed during a CPD arrest. This is an incredibly serious thing to accuse a person of and it outrages me that they may have ruined the reputation of an innocent person. I seriously hope her attorney or the local DA press charges against the CPD for misconduct if she is innocent.

Great work on Chief Dannels and the rest of the law enforcment people. And a big THANK YOU for trying to get these sex preditors off the street. I do not understand why she was released, she should be in jail.

How can the contact be lawful contact if he was a student and when is intimate contact not considered physical. Anyone remember Clinton's "I did not have sexual contact with..." but he sure did have oral sex, that's sexual contact. Intimate contact is physical contact no matter what.
