Myrtle Point fires police sergeant

The city of Myrtle Point has fired a police sergeant who had been on leave since mid-December. Sgt. Yost Espelien had been the subject of an Oregon State Police investigation into whether he had pulled a gun on a man while off duty.

Myrtle Point Police Chief Rock Rakosi said Espelien’s conduct while under investigation prompted the decision. He had worked in Myrtle Point since 2005.

Interim City Manager Randy Whobrey said it was his decision to fire Espelien, but Rakosi agreed based on his belief Espelien lied during an internal investigation.

Espelien was placed on leave on Dec. 18, after investigators began to look into an incident that occurred in late November. He was accused of pulling a gun on a man during a confrontation while off duty.

Coos County District Attorney R. Paul Frasier decided last month to not charge Espelien with a crime, but found details about Espelien’s behavior cause for concern. Frasier would not give specifics, but said his concerns revolved around whether Espelien could be called as a witness in cases.

“Things came out in the investigation concerning the credibility of the officer,” Frasier said. “I believe I could not call him as a witness.”

A letter detailing Frasier’s reservations was included in a report he sent to Rakosi and the Oregon Department of Public Safety Standards and Training in mid-January. The department certifies officers serving in the state.

Whobrey wrote a letter to Espelien outlining the reason he could no longer serve the city.

 “To testify in court on behalf of the state of Oregon in criminal proceedings is a job requirement,” Whobrey wrote. “Your preclusion from the ability to testify makes you no longer qualified to hold the position of police officer.”

At least five cases in which the former officer was a material witness have been dismissed, Frasier said. Most were traffic-related.

“They were nothing I would consider major,” he said.

Eriks Gabliks, the Public Safety Standards and Training deputy director, said his department has an open case on Espelien. Gabliks said Rakosi asked for a stipulated order — or a chance for Espelien to give up his certification voluntarily. As of Monday Espelien hadn’t contacted anyone at the department. Investigators have started the process of reviewing the case for revocation of the former sergeant’s license.

“I can’t say that it will be,” Gabliks said, “but that is the direction we are going in.”

Espelien started his law enforcement career in 1995 in Scappoose as a reserve officer. Then he moved on to the Coquille Police Department in 1997 and then the Washington County Sheriff’s Office in 1999. He resigned from Washington County in January 2005 and was hired in Myrtle Point on July 2005. Espelien was promoted to sergeant in December of that year.

I grew up with Yost and I was shocked to her about any of this. I to was at the Scappoose Police department before and after he became a Reserve. Our family was friends with his and we grew up together seeing each other almost every day. This is not the Yost I know. I am not disputing anything that is said because it is fact. I am appalled by his actions and never saw this in Scappoose. I have not been in contact with Yost for the last 10 years but am saddened by what he has become.Not only hurting your community but his family. I do not know how a person who is sworn to protect the people does the exact opposite. I am sorry that the people of your community didn't know the Yost that I did and I am glad that I do not know the Yost that you know. Not all police officers are like this, not even many are like this. My prayers go out to his fammily and your community.

Thank you to those that have responded so far. We are still looking for others that have experienced their rights being violated, excessive force being used, or any other miss-use of official capacity. Now I want everyone to know that I/we (there were 2 of us in the vehicle) were stopped on routine traffic stop which escalated into what my attorney calls a fishing expedition, then searched without consent for drugs, weapons ect. Intimidation, threats and excessive force was used to detain a person with a squeaky clean record. We want to hear from more of you. Remember there are always higher levels. The state of Oregon needs to reverse all of his convictions to protect the justice system. This is a untruthful officer that has ruined alot of peoples lives, could be he did the same or worse. Just on a chance that he lied before is reasonable doubt.

When I worked for the State Police I was in contact with this officer on several cases. I alway's thought something wasn't right with him. He seemed to enjoy arresting people too much. As a police officer you do not enjoy arresting people as a whole, it's just part of the job sometimes. He seemed to really like to show his gun and badge. We don't need people like this. I'm not at all shocked by his recent actions.

I called the DAs office today to ask them if tere going to review any of this guys cases and they said NO. There is no reason to think he was not truthful in past cases. Holy moly what kind of thinking is this. Guess the Det is right that they only care about convictions any way they can.

The people that are saying... We who have been done wrong by the mp police department should stand together are right. There is still coruption going on at this time. Recently I was traveling through MP and was stopped by the local police and my rights were violated. My life was even threatened at one point. This was on a routine traffic stop. The story of this policeman is amazing to say the least. Why was he allowed to patrol anywhere in Oregon? Will the District Attorney ask for any of his cases to be dismissed? I think not. I guess a conviction anyway you can get it is the name of the game. Paul Frazier should take a real good look at this guys former arrests. The Judges in coos should look back at them too. Oh well what the.... if some were wrongly accused and payed the price.

I know Yost's family and know that they had other possible options as far as living arrangements were concerned. Roc wasn't thinking of Yost's family, he was thinking of himself and how to improve his image. Maybe what MP needs is a FULL internal investigation of the police department starting at the top and working its way down to the bottom. And might I suggest an outside party conduct the investigation!?

This cop made the big news in Portland. they don't seem to have much love for him in Washington County. Well MP ended up with him. I feel sorry for his ex wife and kids. If a cop is crooked call it for what it is. My ex father in law was a cop and he had integrity there's a big difference. Just because you have a badge and a gun doesn't give you the right to abuse your position. Tax payers pay their salary and deserve to be treated with respect just as much as the cops do. They are a public SERVANT and you are their employer basically. They may work for a city,county or state but technically they work for the public at large. Some cops deserve respect and then you have those that don't. And this one doesn;t nor does his chief. They all need to be investigated. Maybe it's time to clean house all the way around.

you dont live in MP! You are talking as though you know the goings on in the MPPD, but you can tell you really dont! What good officers? MP cant attrack good officers with the pay they offer, we have to have newly certified ones or ones about to retire and none are "hand picked". They have to be interviewed by a board and the best one picked. Yost was recommened by Rock, something that Rock is probably regretting now.

The Chief is the problem here folks, he needs to be investigated but everyone is so intimidated by him. the City Manager should be calling the chief to ask the though questions. The D A Needs to ask the court to overturn all of Espeliens cases from 2005 to 2009 because of the background of this officer. If ONLY ONE case is a wrong conviction how do they know FOR SURE that all or most or some were not. Are they willing to give him the benefit of the doubt? THATS NOT JUSTICE. The chief of police in MP is as bad as Yost. He let him bully people and that makes him just as bad. I was reading OregonLive and Esplelien has a bad record from Washington County. The Danger Markers should have been all over this guy. He was hired by MP and almost overnight made sergeant. Somethings wrong here. Hope he can never serve as a cop again.

You may have something there but I think that the Chief should be the responsible party to all of this. He knew all about Yosts past before he hired him. I imagine there will be a couple of law suits over Yost's behavior. And by the way, no one has mentioned that he did all this because he was jealous of his "girlfriends" friends. He also was married with a couple of small kids.

Yost proved himself as a liar, he lied about everything, even things he knew would be checked into. I personally think he was positive that his cheif would cover his back, however this was totally out of Rocks hands. Yes, maybe Rock needs to be investagated too... The Oregon State Police investigated Yost, now the citizens of Myrtle Point need to insist the the OSP investigate the police chief and the City Manager for knowing what Yost was doing to people and doing nothing about it. The Chief and the City Manager is as crooked as Yost is.

I can't think of a thing worse than a untruthful policeman. This whole thing sounds like a bad dream. Why was this officer allowed to do this without harse penalty. I'm wondering about his past too. Has he been untruthful in past cases. Sounds like the Chief of police in MP is a mess too. How many people that were not quilty got convicted with this officer.

The first thing than comes to mind is all of this cops convictions needs overturned. If he was hired in 2005 how many of these cases did he make a false police report or untruthfuly testify under oath. If the DA is really into doing the right thing he should pull all cases this clown was the arresting officer and have them overturned.

It is about time the city of M.P. got smart and got rid of Yost. He was no good in Coquille and even worse in M.P. Glad to see him gone, now maybe the D.A. will continue to investigate all the rest of the things Yost is guilty of.
