Jordan Cove LNG case heads to Oregon Supreme Court

Randy Prince is adamant Coos County failed to consider the risk of tsunamis when it approved Jordan Cove Energy’s application for a liquefied natural gas terminal.

The facility is proposed for Coos Bay’s North Spit within sight of the Pacific Ocean.

He has asked the Land Use Board of Appeals and the Oregon Court of Appeals to overturn the county’s ruling, but neither would.

So the Eugene activist has put the issue before the Oregon Supreme Court. Last week he filed a petition for review. That doesn’t mean the state’s highest court will hear the case.

In fact, the odds are against it.

Stephen Armitage, the supreme court staff attorney, said the court agrees to review less than 10 percent of the petitions it receives.

 Armitage would not say how long it would take for the court to decide whether to hear the appeal, though he said the average is about two months.

In his appeal, Prince argued the county should have revised its comprehensive plan to consider the potential impact of tsunamis, after the Department of Land Conservation and Development found cause for concern in 2002. LUBA threw the issue out on a technicality — that the DLCD never notified counties of its decision. The Court of Appeals dismissed the appeal without comment.

Brett VandenHeuvel added, " Oregon cannot issue a lease of state land unless importing LNG is necessary. The Board determined that there is no proven need for LNG!

"The Land Board has full authority to deny the state land lease for LNG

According to Oregon laws, the leases must be denied unless there is a proven public interest, and the Resolution concluded that "there is presently little justification for the establishment of any LNG import terminals in Oregon ."

The strongly worded resolution was issued by the three-member Board, which consists of Governor Ted Kulongoski, Secretary of State Bill Bradbury, and Treasurer Randall Edwards!

No land permits = No Lng for Oregon PERIOD, no matter what FERC says!

What part of the following don't you understand Native:

1) Structure at Jordan Cove will NOT meet DLCD 2002 Tsunami zone reqirements.

2) LNG ships having known 2 mile hazard burn zone & traveling within a 1/2 mile of populated area here (affecting 17,000 people).

3) California & many areas have rejected LNG for being a air polluter.

4) LNG is 2X more expensive then natural gas used today by Oregon citizens & exists MORE dependence on foreign countries for our energy needs.

5) How 400 Oregon property owners will be FORCED to sell their land to foreign investors.

6) How explosion in Appomattox County, VA could happen here at Jordan Cove (Miles instead of yards).

7) How LNG ship will have negative effect on fishing boats & NEW Airport flights.

8) How no local will qualify for any of the jobs at Jordan Cove.

9) The little extra tax money will be dumbed in indebt rail line & New Airport!

10) Every poll taken & even Oregon's Dept of Energy says NO to this SCAM!

I wish people would do research about this issue and find out the facts before they just spout off what others say. LNG would be great for this area and it is not nearly as dangerous as people claim. Our port used to be the largest lumber shipping port on the west coast before the timber industry was gutted by the environmentalists. If you don't want jobs and industry here move or go back to where you came from.
I would love to see our kids be able to stay here and raise families not have to move to get a decent job.

To We Are Not Stupid and Jobs: SCDC commissioned a white paper on the economic impact of the LNG facility to the economy of the county. It was conducted and written by EcoNorthest, a highly respected Oregon firm out of Portland. This company had significant repeat business from firms all over because of the accuracy to which its clients can rely on its work. The White Paper was roundly dismissed by the Anti LNG people as some type of slanted conspiracy. If you'd like to know what the real facts are, please read a copy. I know this company's work and I know firms who have spent millions in investment in this community based on their demographic research, business plans and economic impact studies. All of them are still in business!

I agree our Oregon leaders should be concerned with the majority's wishes (Need a state wide vote to determine that), but I do disagree with you on the subject of having an open discussion on this subject (Using facts in a logical manner is good & necessary for any/all undecided Oregon citizens out there to better understand the subject better)! As you know, the people that are against this, have nothing to gain ($$$ wise), unlike the Pro Lng people where $$$ is the motivation for it's support! I do wish Oregon state leaders cared more about it's citizens well being/wishes, then the little tax $$$ they would get from this LNG SCAM, that will only be dumped into it's indebt programs as Rail Line, New Airport, etc!

Not that other Gene. Most certainly I have an opinion about the safety and need for LNG in this area but the enemy is not my neighbor who disagrees with me. There is a law on the books in Oregon which prevents the siting of an LNG facility on the North Spit but the 2005 Energy Bill granted FERC the right to override the law. All arguments between us are moot. The name calling should stop. We should be petitioning the government to have our voice restored.

I live here. To those of you who are for LNG:How many jobs will this really bring? Does anyone actually know? What are the qualifications for those jobs? Do you know? In exchange for those jobs, do you know how much private property (not commercial)will be TAKEN for the pipeline? This issue is pitting neighbors against each other. I certainly agree with those folks that say our area should be for more than just retired folks to enjoy. We DO need jobs, and not just minimum wage jobs. But is this really our solution or are we simply grabbing at anything in desperation? Desperate people usually make poor decisions. I submit there is a solution to our economic challenges. It shouldn't come from outside. We have highly educated people right here in the area. We have an awesome workforce ready for the opportunity. We just need a better idea than LNG. We are better than this. We are not just a bunch of ignorant loggers hoping for mill jobs to come back; we are willing and able for an industry appropriate for our area and our way of life.

It may be only 20 jobs, but what doesn't include the spin off work that will be created. I'm sure you can double that amount. Plus the tax revenue that will be generated is more than what we are getting now! One other point, with the new terminal and large ships coming in, it justifies the continuing effort to dedge the Bay. That alone will help lure in new industries to our port. IT'S A PORT PEOPLE!!! If you don't like it, live in Bandon, it's beautiful there.

This Lng is OLD way of thinking people, anytime you increase your dependence on foreign countries for anything especially energy needs, you are worse off (Anyone remember the 1970's oil embargo where OPEC stopped selling to the USA & oil/gas prices tripled in a very short period of time???)! A no brainer on this being bad for Oregon & the USA, very little to gain (A few extra tax dollars, that'll just be dumped into Oregon's welfare system, rail line or New Aiport debt ridden programs going to nowhere fast), but alot to lose (Higher natural gas prices, due to Lng being more expensive, Oregon land lost, especially to the 400 directly affected citizens, air polluter & safety issues that will NEVER get better)! This Republican says NO this useless Lng idea & SCAM is a good word to describe it also!

P.S. Glad someone cares for Oregon citizens that live on or near the coast!

Why does Bob Braddock changes his facts & figures on every detail of this Lng at Jordan Cove? Examples:

1) Full time Employement for locals of this area:

First it was hundreds of full time jobs, then it was around 100-120, then it was 52, now it 39 & no locals will qualify for those jobs due to education & experience requirements!

Bob Braddock paid reports/polls:

1) Lng at Jordan Cove is safe in Tsunami zone for 55 foot waves, yet DLCD says up to 100 foot waves in pamplets handed out to the public at Oregon's visiting centers!

2) Says majority of Oregon citizens are in favor of this, yet ONLY 400 voters were polled vs Millions that live here & every poll in newspapers (Including the World) & radio's show it running about 2 to 1 against!

At a meeting last year, Bob Braddock said this structure could withstand a 9.3 Earthquake, yet when someone asked for the detailed engineering drawing, bob said he forgot to bring it with him!

Anyone see the obvious here, Bob Braddock will say or do anything to "con" this project through!

I think it may be time to earnestly start forming the State of Jefferson again. The people to the north are trying to double cross the southern part of the state again. They don't want jobs here so that they can have unobstructed views of the coast. How would they like it if all the jobs were driven away up north so that we had an unobstructed view of the valley? As to the people claiming that this pipeline wouldn't bring in jobs for the south coast think about this: Who will feed, clothe, house, provide medical care for, educate their kids, provide recreation for, & support the people working for the pipeline? Just because everyone on the south coast isn't qualified to run the pipeline it doesn't mean that there won't be any jobs from it. Crack open an economics book sometime...

The dangers may or may not be real, but there is another issue.

We are trying to wean ourselves of foreign energy. We are trying to support existing local businesses, and we want Oregon to be for Oregonians.

This project is a foreign company with foreign investors wanting to build a foreign operated plant to import foreign energy to sell to a domestic foreign market (California) and returning the profits to a foreign country (Canada). The money will not stay here.

Support Oregon. Support the Coos Bay Area. Support local business who already employ thousands in the service industries. When this refinery drives away the tourist, who will employ the thousands already employed whose jobs are being put in peril for 20 short term jobs (These LNG operations are bailing out all over the world.) Even if they hired a hundred people(and they won't) they will displace hundreds more who are already working. Hope is great when your hungry, but do you want to hope for a menial job at the LNG facility at the expense of your neighbors who would lose their jobs?

It's about time! I see the majority of opinions here are coming from the pro LNG voices. Before, it was always the same folks throwing out the constant BS over the LNG terminal. The fact is, we all know that it has nothing to do with safety or fear. The real fear is that they don't want the ships, trucking, industry, ANY kind of growth in the Bay Area. It's the same folks who shoot down anything and everything that is proposed to coming in... Thank you to all those in favor and are now speaking out.

There isn't any common sense involved with comments about 100 foot waves. If they even knew a little about the physics of hydraulics they would know it isn't even possible for a 100 foot wave to make it to the beach. It would crest and break in about 100 fathoms. The serge of water would be the main problem which would be like the tide coming in and going out in an hour or so. The problems start when it is already high tide. If, and I say IF, any of these events happened to create a 100 foot tsunami, you would be better off grabbing your ankles and kissing your, well, you know the rest.

Having an earthquake, then possibly a series of tsunamis hit the coast is bad enough. A flaming tsunami sounds like an alcoholic drink and would be comical if the devastation potential wasn't so horrific. Let's listen to science instead of the same old drumbeat of another buck. How the county, appeal court & the rest can just ignore the obvious "The Tsuanmi Hazard Zone" along the Oregon coast where it legally states on Highway 101 that you are entering or leaving a Tsunami Hazard Zone! Also the pamplets handed out at Oregon's visitor centers along Highway 101, stating info about the Tsunami Hazard Zone, talking about the up to 100 foot Tsunami waves caused by a Major earthquake fault (30 to 50 miles off the coast of Oregon), showing a map of the Tsunami Hazard Zone areas & where to go to be safe! If the Oregon supreme court ignores this critical safety "legal" issue then it should be moved forward into the Federal supreme court due to that critical safety "legal" issue of Oregon citizens in or near that Tsunami Hazard Zone area!

All this concern about tsunamis is almost comical. If a tsunami hits Coos Bay the LNG depot will be the least of everyone's concerns. We live under the threat of tsunamis. California deals with earthquakes. The midwest has tornados. The southeast has hurricanes. The south has floods.
Let's move forward and get some JOBs into this area.
