Third assessor employee files claim

A former Coos County Assessor’s Office employee has filed a tort claim notice with the county, complaining of harassment in the office.

This is the third claim singling out the department in a little more than two months.

Attorney Juli Hall Upton sent the notice dated Oct. 12 to county attorney Jacki Haggerty’s office. It was received on Oct. 29. Upton represents county employee Tamara M. Houghton.

The notice contended Houghton was the victim of sexual harassment, emotional distress, unequal treatment based on gender, intentional harassment and a hostile work environment.

Houghton also contends the county and Assessor Bob Main failed to address the problems and she listed negligent hiring among the reasons for the claim. The notice did not indicate who Houghton was referring to with the negligent hiring claim.

With the exception of the hiring complaint, the circumstances leading to the filing appear to be similar with the previous claims. Eugene attorney Brian Pocock, representing Angela Provost-Allen, sent the county the first notice in late August. Upton also represent a second filer, Kay C. Roach, whose claim was sent in early September.

Houghton sent the county a letter describing incidents where she felt victimized starting in October 2007. The county released a copy of the tort claim letter, which is public record under Oregon law. Prior to releasing the document, the county attorney’s office blocked out employee names. The letter included details of 16 incidents, but said there had been more.

According to the letter, Houghton has moved to a job in the county Information Technology department.

Assessor-elect Adam Colby was placed on administrative on Sept. 30, following the first two letters, but the decision was made after Colby requested the county investigate personnel issues in the office. That request came in connection with claims of harassment.

Colby’s attorney, Adam Gould of Coos Bay, said in a press release last week that Colby is back on the job.

“Beginning immediately, Adam Colby is no longer on paid administrative leave and is performing special transitional duties in preparation for his role as Assessor,” the press release said.

The release does not describe those duties and Gould declined comment about whether that means Colby is going to be working in the assessor’s office. Human Resources manager Steve Allen said he had not seen the release and would not comment further.

Colby and Main were named in all three of the tort claims. None of the claims alleged that either Colby or Main engaged in sexual harassment.

What change did Adam Colby implement other than changing the entry way and opening the lunch hour to the public. All, good and good, but nothing earthshattering. Treating staff members is truly a much more important quality in a work environment. Of course, serving the public is great by opening the lunch hour. Creating a hostile work environment is not a positive factor by any means.

t is evident that supervisors, Barbara Foord, (retired) and Tamara Houghton switched to another department. Perhaps this is self-evident of personnel leaving a sinking ship. I know both of these ladies and what fine qualities they possess. Filing a claim is extremely stressful but can help one to feel somewhat more secure in that harassment cannot be tolerated and hopefully eliminated in all work places. Filing a notice of intent is not a lawsuit and there are time limits in filing. Thus, an employee has to make a decision – whether to endure and be silent, or be courageous and file. This takes a great deal of courage to put yourself out there like this.

I have known Tamara since she was a little girl and always found her to be very honest, hardworking, and knowledgeable in any field that she engaged in. I support her in her efforts in dealing with a difficult situation. Tamara is very caring and compassionate of staff members in dealing in this very hostile work environment.

I find it interesting that Mr Colby & Coos County Human Resources boss Mr. Allen were seen having an ammicable lunch together. How is it then that Mr. Allen can do a fare and unbiased investigation of Mr. Colby or his supposed unprofessional employees?

Change in government always occurs and for the most part it is positive. Once Mr. Colby became Assessor elect and Main became Commissioner elect, they put on their new elected position hat. Main took off and Colby jumped the gun. There were numerous complaints made to Main and to the Human Resource department. Main chose to ignore them and he is getting what he deserved. Colby created the hostile work environment and Main went along with it instead of dealing with the problem. It will all come out in the end one way or the other. Let's give it a chance.

It seems to me that anytime a new person comes in and implements changes that will improve efficiencies and save the tax payers a buck or two, some one inevitably points a finger and screams "witch". The integrity of the office is lost as more people jump on board the witch hunt train, and it's a train wreck coming down the tracks.

I would like to remind everyone who it was that called for the investigation. It was Adam Colby. Why did he do it? Perhaps he would like to finish this disruptive business about a hostile work environment and get back to the business of running the Assessor's office with some modicum of respect...respect for and from his fellow coworkers, fellow public servants, and the citizens of Coos County.

There is always resistance to change, and some level of resistance is normal. But the people who have the guts to take on the tasks of implementing meaningful change in the face of adversity, those are the people I want working for me.

Before the election two of these ladies told me face to face that Mr. Main was the world's best leader and how happy they were to be in that organization. I am credible and hopefully soon I will be a witness for the accused. This would not be the first time a lawyer has been duped by a person jumping onto anothers claim.

Those of you who served in the military know the consequences of going over your commanding officer instead of following the chain of command. Maybe thats why Adam Colby is no longer in the military. Too bad we can't court martial him before he takes over his elected position as a department head. I bet his suborinates won't be allowed to follow his example.

County government is inefficient. People are entrenched in their jobs. Some do good work, some not. People have been doing things the same way for years. It is the culture. Change will be an uphill battle. Good luck with that.

Ever been afraid of losing your job if you blow the whistle? Where there is smoke there is usually a fire! Bob Main should have tended to business instead of believing he was a commissioner once being elected but not being sworn in. An "Obama" he is not. have you stopped to think that "Snakes wear suits" sometimes. I am a family member of one of the employees who filed the tort. If you knew two cents from the truth you would see that we elected a moron who is only going to cause more problems then he would fix.

I don't know how many times I have been in the office to visit employees and could feel the tension in the office. It was not a health work environment no matter how much the employees tried to make it so.

Next time think before you judge and support a "LOOSER".

Good people skills are a requirement both in and out of an office and Mr. Colby's people skills only extend to the world outside of the Coos County Assesor's Office.

Why doesn't Steve Allen in Human Resources know anything about it. Is't that where Adam's check is generated from?

First article is A Ghost from Boonville's Past: Johnson's Tale datad 1-17-02.

The Second article is The Rise and Fall of Jom Johnson dated 11-12-02.

After reading these articles it sounds like what Adam did at Konocti School District is the same thing he is doing in the assessors office. The article states that Adam "Jumped Ship" in order to beat the move to toss him over board.

It that why Adam turned in his RESIGNATION dated effective 4-1-02 before the school year was over?

i met mr colby and he seemed to be a straight forward type of a person,was really into his job and informative.it was at a tax meeting for the new yr. i do belive some of the under laying problems are pretty much due to the changes he has proposed at present and future for the dept,some people cannot handle it.and maybe they should move on..sexual harassement is some times easily used,and is hard for men sometimes to prove inocentice of and now we have 3 claims all with the same ring to it,a guy doing that with 3 women sure wouldn't have much time for their job.. strange!!
