NB still not settled on sliding house

A recent attempt at mediation, between the owner of a dangerous house in North Bend above Sapphires Mongolian Grill and the owner of the eatery, remains unresolved.

On Monday, City Administrator Jan Willis said the men who are suing each other have not reached a solution, nor has a lawsuit against the city been resolved. Home owner Yesi Guirado and restaurateur Eugene Hill have been at odds since 2007, when city staff notified North Bend officials that the house could be a public hazard. Located at 2505 Sheridan Ave., the house is perched on slipping land and could potentially slip as well.

City Attorney Mike Stebbins said the issue could be resolved at any time between now and the trial date in April. The city was represented by a member of his office, Stebbins & Coffey, as well as by Portland law firm Hoffman, Hart & Wagner LLP.

Stebbins said he could not describe the tone of the mediation session, which took place on Sept. 4, as all parties signed confidentiality agreements.

AS I HAVE STATED BEFORE: The taxpayers in North Bend should be up in arms about this entire situation and invade City Hall with their concerns about the City not resolving this situation. It is a total waste of taxpayer money and taxpayer for something as dangerous to drag on for this long. Residents get together and invade city hall, invade the city councel meetings or whatever it takes BEFORE SOMEONE GETS KILLED because of the hill sliding or whatever.

why doesn't the city condeme the property as a public nuience, abate the problen and put a tax lien on the property for all cost. Its much cheaper and quicker than going to court.

this is why i have nothing positive to say about local politics and the city of north bend.that house on top of the hill should have been ordered torn down by the city council over a year ago.

The issue at hand is that the Mongolian grill proprietors own 2/3 of the hill in question. Why haven't we heard anyone bring this up instead of blaming the city for everything? The grill owners knew what they were getting into with respect to their business and location.

Then they could say i told you so.

But this is'nt the reason the place went under. Was the low quality food at the high prices. Gotta pay those loans, and no customers means no cashflow. Brand new resuraunts cost alot!

Most everyone whose lived here any length of time knows of the historical problems with that lot.

how about the world does an article on that subject so they can educate everyone on the events leading up to this. There's a lot of finger pointing and sure, some parties might be guilty, but it's important to know that the restaurant shouldn't have been allowed to be built there based on geological events of decades past.

Incredible. Management and leadership in NB cannot meet their own deadlines much less enforce those imposed by them on others. We need to replace this entrenched bureaucracy with ordinary mortals who will put community first, and not threaten actions which they are afraid to take. They gotta go.

What happened to all the trees that were behind that house, holding the hillside together? Seems pretty easy to see the responsible party is the one who removed them. Now there are eighteen more people out of work and another business closed in our area. Good job North Bend.

I do not understand why the Grill was built there in the first place. That hill has a history of sliding way back into the 60's. There used to be about 4 or 5 homes there. when the first slide happened, that should have been a warning sign. I do know that one house was hit by a slide, and i think a second one was tore down because of the hill. Why things where never corrected back then, and now before things like this happen. Now you have two people blaming each other, when the city should have either condemed the properties, or shored up the hill side. The city is also to blame as well. And what about the other homes on that hill. It's just going to be a matter of time before those homes are going to meet the same fate.

how long is the city going to drag its feet on this? until someone gets hurt or the Grill is damaged? the city has given way to much time to the owner and this issue of suing each other is just a way to bide time. Step in and get it done!!

Even with the house gone the mud will slide as well. I just won't be a house slide it will be a landslide. So remove the house, and let the mud slid and cover the Grill. So then it's a win win for both.
As for suing NB City and the Pancake owner for the cutting of the trees when they were trying to sell the property. Because we all know that NB City owns proterty that is apart of the sliding fact.

Make this problem very simple> Citizens of North Bend should be up in arms about this dangerous dituation. The citizens of North Bend should invade their City Counsel meetings and insist that the City inforce their City Ordiences. What is the City going to do, just postpone and postone this problem until someone gets killed. TO THE CITIZENS OF NORTH BEND: If the City government handles this situation in the way that they have, which is mostly nothing, then they would do the same thing to YOU if something like this happened to you. Require that the City inforce THEIR OWN CITY ORDIENCES. Problem solved. What a total waste of tax payer money in government.....What a shame

It was a nice park at one time by the highway but greed took over all the people involved! The lots north of the house will be next for the World to write about and the city to get fees from. At least the World used the words like could be a,could potentially slip. They have a court date but what court house.

I cannot believe the City of NB has let this go on so long. It's their fault now the restaurant is closing and the owner built that for nothing.
Such a nice new building and can't use it with that unstable hill behind it.

Oh, just let the rain wash the house away and land of type of one of the patrons of the Mangolian grill, then they can sue the heck out of NB for their lack of public safety, and building code enforcement. That will put a end to this.
