CABO SAN LUCAS, Mexico (AP) — A Mexican prosecutor says an Oregon tourist drowned in his own blood while in police custody.

Sam Botner of Yoncalla, Oregon, was arrested on Aug. 27 in the resort of San Jose del Cabo and was later found dead in a jail cell. Prosecutors say a surveillance video shows officers beating Botner.

In an interview Thursday with The Associated Press, state prosecutor Fernando Gonzalez said Botner suffered a ruptured spleen and then died of asphyxiation after internal bleeding blocked his airway.

Six police officers are under house arrest in the death.

Prosecutors have two weeks to determine whether they will bring charges in the case.

I live in Mexico six months of the year, six months in Canada. Retired 'big city cop'. Two observations. 1) You look for trouble it will find you. 2) I can assure you that violence by authority figures anywhere in North America is a very real and probable outcome when the 'attitude test' is failed.

Gene wrote on Sep 13, 2008 5:43 PM:

It is a sad thing when someone dies while in custody. It isn't anything that is desired by any police agency. However, when someone wants to fight back, they better be ready to suffer for all the verbal abuse stored on the cops. Once they lose their cool, it gets out of control quick. This rule doesn't just apply to cops either. I have worked with many Mexicans over the years and found them to be harder working than most of other races. They tend to be more honest and family oriented also. There are bad apples in all the races and to get technical, we are all from the same branch of the evolutionary tree. So, doesn't that make us all cousins? Oh yeah, I don't like a few cousins but, I don't want to see them come to harm. Everybody deserves a chance at a good life. Anyone thinking they wouldn't try to cross the border is things were reversed is either lazy or a liar.

Officials are to blame not race. If the suspect was uncontrollabel and the officers had to subdue him by administering a beating then the next guidline they should have followed was if the suspect was injured badly to seek medical attention and not ignore the situation as if the job was done.

yes i am sure if he was black someone would do something.. another example of stupid racism also of coarse they came here for a reason to feed their families which alot of them cant do by working in their countries if your family was starving wouldnt you do anything you could including break the law to feed them? i know i would. also this is a country built by immigrants who stole this land from the indians and then killed thousands of them but you want to complain that they come here and work, supposedly collect welfare(even though most of them work harder than most white people i have seen especially in this area where most of the white people are strung out on meth) what a shame that so many are racist maybe if you took the time to get to know some of these families you would realize they are some of the most caring, sweet, considerate people you will ever meet

It is wrong to blame all cops or all mexicans, etc. It is just plain wrong to do that. If you are out of control then what are cops suppose to do about it if you attack them? If this person was drunk and out of it then he can be a danger to himself or anyone else. In this case I think it was both.

I have to agree there are bad people in all races and cultures, but why should we have to put up with the ilegal ones. Get rid of the ilegal mexicains would cut alot of crime not to mention social services. Might there be a reason they left Mexico? To bad the victum in Mexico was white, if he was black someone would do something about it.

As others have noted:

1-Police have a history of abuse all over the world

2-Mexico is corrupt

3-Don't go overseas and expect US law to apply

This guy got stupid in the wrong place at the wrong time. Other people go overseas and they are just unlucky, like the ones who died in Bali a few years ago. You can also stay home and get run over by an illegal alien like we had happen last winter. There's no guarantees of fairness when it comes to living on this world. Be careful. Be nice. Be armed. Be all of the above...LOL!

Thank goodness God sees every act and deed....that is the only thought that moves me forward...otherwise all the violence and ignorance in this world would go unpunished....God will get them in the end...AMEN to that.

That's what I tell myself when I think about all the atrocious acts I hear poicemen get away with... or even the simple ones like arresting me and putting me in jail (in America) just for asking to see a copy of a warrant. Thats all I did..... told the cop I would give him a guided tour of my home but show me the warrant with the judges signature...so,ething an honest cop told me to always do because people imitate cops all the time. Hmmmm...land of the free????? I had no record (ever) or traffic tickets. I guess it is easier for cops to arrest someone for "no crime" than to go and chase down a rapest or murderer..then no cops can be found.

To stigmitize and entire country and people based on individual actions is ignorant. What has been stated here about MX could be said for others wanting to travel to our country. There is corruption and bad people everywhere.

My husband and I travel to MX multiple ttimes a year. We don't over indulge, we are respectful of the people and their culture, we treat them the way we expect to be treated and never have a problem.

We don't assume that all MX are lazy. In fact most are kind, trusting, honest, hardworking people. More so than what we see in the community here that we live in.

How Mexicans are treated here? Illegals or Naturalized citizens? The citizens have more job oppurtunities and other advantages over most people. The illegals also have job opportunities and commonly exploit medical attention. Our justice system is so liberal that if someone so much as says something that may be interpreted as slander against minorities they will be burned at the stake. Didn't you ever read about the two border patrol agents in prison for 25 years for allegedly shooting a mexican drug dealer who almost got across the border? We prosecute our own people for mexicans, so i have to ask, what do you mean "revenge for the way they are treated here?" They beat one of ours to DEATH, are you a slow learner or something?!!
