LUBA returns LNG case to the county

The Land Use Board of Appeals has remanded Jordan Cove Energy Project’s land-use application for a liquefied natural gas terminal to Coos County. LUBA found Tuesday that the board of commissioners failed to address some of the opponents’ archaeological and environmental concerns.

LUBA disagreed with opponents on several issues, but agreed the county needs to review its conclusions, including whether there are wetlands in the North Spit area proposed for the LNG terminal.

It also suggested the county cannot fulfill its responsibility to resolve disputes between local Indian tribes and Jordan Cove over archeological sites under the agreement proposed by the company.

LUBA said a third concern was unwarranted. Opponents had argued the county should include a condition that construction of a pipeline be approved before construction begins.

Project opponents quickly issued a press release, welcoming the news.

“This LUBA decision is a big win for the people of Coos County and Oregon,” said Jody McCaffree, of Citizens Against LNG. “The Coos County Commissioners should have listened to their constituents’ legitimate concerns.”

Not everyone involved had seen the decision, including Oregon International Port of Coos Bay Executive Director Jeffrey Bishop. He said he couldn’t comment on it because he hadn’t read it. Jordan Cove Project Manager Bob Braddock was not available at press time.

James Nicita, the Oregon City-based attorney who successfully argued for the appeal, took the decision as a sign of more problems to come for Jordan Cove.

“This is the first major permit that Jordan Cove has sought, and LUBA’s decision is a huge signal to them that their project has major problems.”  

David Lohman, a Medford attorney representing appellant Southern Oregon Pipeline Information Project, said LUBA’s decision extended beyond technicalities.

“Correcting the problems with this permit — if Coos County decides to try to do so — will require a lot of new work by Jordan Cove and the County, including public involvement processes that were skipped over before,” he said.

1) Twice as expensive as domestic gas, 2) Pollutes more then domestic gas,
3) Violates Oregon citizens land rights (Forced to sell their land of 80 ft wide section in order to put a 36 inch LNG pipe through just so California can get the gas)
4) Located in Tsuami zone
5) People live within the 2 mile BURN zone if LNG ship catches fire & blows UP
6) Local fisherman will NOT be allowed in bay or near jetty MANY times of the day due to LNG ships coming or going,
7) This will produce about around 45 jobs, which NO local will qualify for due to education & experience requirements.

Add it up & it's ZERO for Oregon & the USA. Now you know WHY California & HUNDREDS of other areas across the USA have rejected this LNG SCAM!

May09,2008 issued a report to the public on Lng that read:

Lng is twice as expensive as regular natural gas used by Oregon citizens presently & polluted more also! Any/All future gas needs by Oregon would come from the Rockies at 1/2 the price of Lng & would pollute less too! Finally, concluded that Lng was not needed in Oregon!

What part of Lng being 2X more expensive & pollutes more then regular natural gas used today by Oregon citizens & not needed, didn't you understand UNCommon Sense, Frank, NB man, Only Jcep wins, Ronop?

The only group that benefits from this decision is Jordan Cove. Since it has been argued before LUBA, no other information will be able to be brought up, and the only issues will be those that were remanded back to the county.

I am adamantly against LNG, however, the commissioners obviously did their job as there was nothing reversed at LUBA. We wanted a reversal to show the voters that the commissioners did not do their job. Unfortunately, for us it is obvious that the commissioners did do their job A remand of the issue back to the county just gives Jordan Cove the abiility to build a strong application. So this is not a win for the community but for Jordan Cove. Thank you commissioners for at least doing your job.

Corinne C. Sherton of Johnson & Sherton, PC, was also one of the attorneys that successfully argued for the appeal. I do not know why she was not meantioned in the press release but should have been. LUBA sided with several of her agruments and remanded those issues back to the county.
