Bicyclist’s family files lawsuit

PORTLAND (AP) — The family of a bicyclist struck and killed by a garbage truck last fall has filed a $1.5 million lawsuit against the driver and his employer.

Brett Jarolimek, 31, was killed as he traveled down a bike lane into the path of the truck turning right in North Portland. The prevalence of such “right-hook” collisions spurred city officials to order green “bike boxes” installed at intersections around the city this year.

The suit filed Wednesday claims Bryan Lowes, 41, of Oregon City was negligent on the morning of Oct. 22, 2007.

The lawsuit claims Lowes was driving with a broken right-side mirror, affixed with a bungee cord, and failed to yield to the bicyclist in the bike lane.

According to court records, Lowes has at least 25 convictions for speeding, driving without a license and other traffic violations.
