CB School Board discussing move to boot member

COOS BAY — A question about residency has the Coos Bay School Board questioning whether to vacate the seat currently held by Wally Hazen.

Now in his 14th year on the board, Hazen owns a house on Cape Arago Highway, well within the boundaries of the Coos Bay School District. About five years ago, he purchased property in Fairview out past Coquille, where he subsequently developed a blueberry farm and built a second house.

Several months ago, School Board Chairwoman Kathy Murray learned from an unnamed source that Hazen was spending a significant amount of time in Fairview. She shared this information with Superintendent Bob De La Vergne and the district’s legal counsel, David Dorsey.

At Monday’s School Board meeting, Dorsey raised the question of whether Hazen no longer qualifies to serve on the board.

In a presentation that cited Oregon Revised Statues, case law and several dictionary definitions, Dorsey essentially said it was up to the School Board to decide if Hazen could remain in its ranks.

Given several options, the board chose to schedule a special meeting at 5 p.m. on Wednesday, Feb. 20 to discuss the matter.

Hazen said he spends nights in Fairview when he is pruning his blueberry crop in the winter months  or during July when the fruit is harvested. He considers the farm to be a business, while he thinks of himself as a Coos Bay resident.

“Coos Bay has been my home and it will continue to be my home,” he said.

Hazen said before he ran for re-election in May 2007, he briefly considered running for an at-large seat on the South Coast Education Service District. He opted to run in the Coos Bay election after consulting with Coos County Elections Department staff. They advised him that because his driver’s license, vehicle registration and voter registration list his Barview address, he was within the letter of the law.

“The Coos Bay School Board is where I prefer to be,” he said after the meeting.

In his presentation, Dorsey explained that a School Board can vacate an office if the holder “ceases to be a resident of the district or zone from which nominated.” He noted that Hazen’s house in Fairview was approved for occupancy in the fall, though much of his mail still is sent to the address in Barview.

“This is an issue about which reasonable people can disagree,” Dorsey said. “The fundamental basic decision the School Board must make is whether to take Mr. Hazen at his word when he says that it has been his intent to be a resident of the Coos Bay School District or instead to go by the old saying of ‘actions speak louder than words.’”

Dorsey said the board could do several things. It could ignore the issue, postpone discussion to a later meeting or hire a hearings officer to conduct a meeting and gather public input. He also said the board could vacate the seat if four members agreed to do so, though he recommended against doing this  to allow for public comment and for Hazen to further consider the situation. Board Members Andy Post and Randy Miles were absent, which also contributed to the decision to postpone deliberations until next week.

The only comments from a board member other than Hazen came from David Ford, who joked that Hazen should have purchased a property along the Coos River, which would have prevented such discussions from occurring.

“I think of you as part of the Coos Bay community rather than Coquille’s,” Ford said to Hazen. “But there will probably be other input.”

Hazen said that while the Fairview house has been approved for occupancy, he is still making improvements to it. After the meeting, he would not say if he spends the night in the Fairview house or inside a travel trailer, parked on the property for about the last three years. Hazen said he thought at one time he might retire to the blueberry farm, but now has plans to build a new home south of the property he has in Barview. He currently shares the existing house on Cape Arago Highway with a daughter, son-in-law and grandchild.

Hazen remained confident he would avoid having his seat vacated, noting his long service and popularity with voters.

“I think the record will be very clear,” he said.

SO this gentle sought a position on the school board and won the right to be there. How many other people in this area have stepped up to the plate?

If these board members are the right people for the job then where is the right person? Maybe if we improved our schools and raised worried about raising the standard of living for residents in this area (that doesn't include putting them on the welfare rolls, food stamps, or encouraging them to cook meth) we could attract the right people. Apparently people who live here are either not qualified or are more suited to passing notes in class, back biting, or spreading gossip.

I would rather have seen something in the paper about how these board members aare working on solutions to our children's education then to see they are more concerned with this nonsense!

Has Kathy Murray offered a suggestion for Wally Hazen? Kathy, you need to re-evaluate your coomitment to the children. All of the board members do. Since most were absent when action was to be taken on this matter, which should be the lease of their worries.

While I believe the "devil is in the details" sometimes the first person to recognize this is the devil.

it is clear that this "BOARD"'s focus is as disfunctional as the college board. It is no small wonder that so many important issues are left slipping into the cracks and ito the eternal abyss. Too much politicking, too many personal and private intrests. Too little REAL energy going into solving the real issues that are deteriating and pushing us all into misery.

doesnt the coos bay school board have more important things to do than worry about where one of there members live or doesnt live. If Wally has done a good job in the past what does it matter if he has property in fairview.He should be judged on the job he does not where he puts his head on a pillow at night.Get on with the real issues of educating our children and stop wasting time and money, Good Luck Wally. you have done a great job on the school board and I think you will continue to do so.

As the Mater has come to light it is well to discuss the issue, not ignore it. Many Coos Bay RESIDENTS have business and property interests in other areas. SO WHAT. I don't care where he intends to retire. He is a legal resident of Coos Bay. He has personal and business property that he pays taxes on here. It should not make any difference if he only rented here. We have had School Supertendents that were residents of Washington State and they were good enough to work here. We need more Educated minds not more ignorance. Thanks for your service Mr. Hazen.

I have known Wally for about 15 years. I have taught both of his daughters. When I worked as a teacher for CBSD, he was one of my bosses. If there is anyone I want on a school board, it's Wally. He is fair, consistent and has a broad knowledge base. He knows what is right for the school district, he knows what is fair for the community. The man has integrity. The fact that Wally has been involved for 14 years signifies his competence. Kathy, take your toys and go play with someone else.

I know that anyone who serves on the board is dedicated because it involves a lot of time and a lot of headaches. Anyone voluntarily serving in a public offices faces constant scrutiny and very little, if any, glory. I don't think it is fair to bash Kathy Murray for doing what she thinks is her job as chair person. I also don't think anyone can question Wally's dedication to this district...I mean 14 years is a long time to volunteer for anything! Now it comes down to intent. This is an issue that has to be resolved, so let the board do what we elected them to do and quit the bashing!

Harold, this is not about liking or disliking. I truly respect anyone who puts time and effort into public service. The issue is whether he is manipulating the system and there by creating a legal issue for the School District. I assume the only way he can remain on the Oregon School Boards Association’s executive board is to serve on a local school board. If he would have run for the ESD board last election there would not be an issue and I’m sure he would have won handily.

This is not about Wally Hazen vs. Kathy Murray. Kathy Murray is our board chair, was confronted with an issue about my residency and chose to deal with it in a public meeting. Prior to filing for my position, the election board asked me a series of questions; what address do you use on your ODL, voter registration, vehicle registration, utility bills, where do you receive your mail and what address do you use on your tax returns. The answer to all of these questions is Coos Bay. I voted last July to support Kathy as our board chair and I support her still today. I thank you for your support, but please let the process work. As to the question of my owning properties in the Coos Bay school district, you may go to the county assessors, it is public information. I am half owner in a piece in North Bend, own a piece in the Coquille area, and have 8 taxable pieces in the Coos Bay district, my primary residence being one of these. When a bond is passed to buld two new elementary schools, I will be paying taxes.

Please read paragraph nine of the above story and then tell me Mr. Hazen thinks he is above the letter of the law. It is evident to me that your dislike for Mr. Hazen is the problem, not his performance as a school board member who for 14 years has volunteered his time and effort. It is inconceivable to me that anyone would attack Kathy Murray for performing the duties of her position and honoring her oath of office. The question is whether Wally Hazen built a home outside of district 9 boundaries with the intent to live there. He has been a School Board member for 14 years. He knows the requirements of the position. In my opinion he believes the rules do not apply to him. If he remains on the board he is jeopardizing the legality of decisions made by the School Board and that could be very costly to the district.

In regards to the article written in Teusdays World about Wally Hazen. Firsts and foremost I believe the issue is and has been blown out of proportion. We have much more important issues at hand then where Mr. Hazen sleeps at night. Yes he has property out of the school district, as does Kathy Murray, who has property in Portland, which is where she is now. Her cell phone is out of that area, however I don't see her residency in question. I am sure other members also may have property elsewhere. What is the big deal? Mr. Hazen has devoted much of himself and his time to the school board and school board activities. Let us all not forget this is an unpaid voluntary postion and for someone to devote their time as he does is wonderful. Mr. Hazen is a great asset to the board and should be treated as such. To boot him, as you say would be a great loss. We should all be thinking of the schools and our kids, not about something so trivial.

I would be interested in knowing what the other board members have to say. I will be willing to bet that they are not at all interested in where Mr. Hazen sleeps or lives. They are interested in his value as a school board member. 14 years of dedicated service speaks for itself. In most allegations of this sort there is a personal axe to grind and knowing Mr. Hazen as I do I would bet that Kathy Murray does not like the fact that Mr. Hazen walks the walk. He stands up for what he believes and is not afraid to say what he believes and act upon it. Mr. Hazen does not take anything in his life lightly and gives an amazing amount of thought to all of his endeavors. If Ms. Murray does not like the fact that Mr. Hazen does not dance to her tune then I suggest she find another line of work.

I find it very interesting that this came from 'A' source. Not sources but 'A' source. It sounds to me as if someone has an unjustified grudge. This particular source and Kathy Murray should be proud of the fact that during the pruning and harvesting months Mr. Hazen will drive the 45-60 minutes to attend meetings. He was even appointed to the State School Board because of his constant interest in the school system and the need and want to make things better. If that doesn't show dedication then what does?

I hope Kathy Murray can get focused on the real issues. Maybe it should be her spot vacated. I also hope this is not costing the tax payers additional fees for the attorney to research. Mr. Dorsey should have explained to Mrs. Murray that this is a waste of time. If he is getting fees for doing this extra research he should be ashamed.

Whomever first made this an issue should be feeling very ashamed and embarressed. Are there not more important issues to be discussed? Who ever Kathy Murray's 'source' is should have obviously done their research first. Does she or any who are involved negatively with this realize that in the 14 years Wally has been on the board he has missed one meeting! One meeting out of the hundreds that they have had. He is a very busy individual and enjoys contributing to the Coos Bay School District, otherwise he would not have continued to be on the board after his youngest daughter graduated 8 years ago.

If you have someone who is doing a great job at what you elected him to do and is serving within the parameters in which allows him to do so, why are you wasting time, money and resources? I agree with everyone so far. He's done a great job, is a good man and I don't think it matters that he owns a second house out of town. Big deal. He's a businessman as well as a School Board member. He has a lot of responsibilities and handles them all very well. The fact that his business out of town might demand a good deal of his attention, doesn't mean that he's no longer a valued member of our community. I went to school with both of his daughters and knew them quite well. It's apparent to me that he was a very good father on top of all his other jobs. I respect anyone who can take on so much in life and be successful at it. That's the kind of person we NEED on our school board. Hell...make him MAYOR! He's obviously still dedicated to his position on the school board, despite the fact that both of his children have long since graduated. He should be rewarded...not removed from his position. Shame on anyone who believes otherwise.

14 years shows loyalty and dedication. Kathy Murray needs to really focus on what is important. He lives in Coos Bay. Does Kathy know anyone that lives in Coos Bay and does alot of business out of town? Does that mean that person lives out of town? I think not. I spend alot of time in Portland and California... I wonder where my home is? Lets quit the immature squabbling and work on educaton so my child, and others, can try and get a good education...that they deserve...and barely get.

Who is Kathy Murray's unamed source anyway, her cousin or something that thinks he or she can do a better job than Wally? Ain't gonna happen. It will be hard to fill his shoes. He is a good man, after all these years, he should'nt even have to explain himself as to what he does with other properties that he owns. It is no ones business. He needs to keep his position on the board and I vote and pay taxes!

He has served admirably for 14 years and has done a lot for our community, schools, and children. As a resident of CB, I see him as a resident of CB as well who owns his business in Fairview. Makes sense to me. what a waste of time.

What business is it of Kathy Murray's where Mr. Hazen resides? Does it affect her in any way personally? Kathy Murray obviously needs to focus her attention elsewhere. How long has she been a member of city council? As a former resident, I can assure you that she would never have had my vote, I feel fortunate not to have her involved in my personal affairs.
