Judge sentences man in hit-and-run deaths

COQUILLE — After running down Dallas and Marilyn Vance with his truck, Oct. 16, at the Pony Village Mall, North Bend resident Noe Garcia Moncada fled the scene.

Not only that, he returned to work for two days without any concern for the Springfield couple’s welfare, said Judge Martin Stone. His comment came just before handing down Garcia Moncada’s sentence during a hearing Friday morning, at the Coos County Courthouse.

His punishment?

Two consecutive 36-month sentences in the state penitentiary, for a total of six years in prison.

He also would be placed on two years of parole and five years driving suspension. But that’s only if he remains in the country. A citizen of Mexico, Garcia Moncada, 30, also faces deportation at the completion of his sentence.

The Vances died as a result of their injuries from the hit-and-run in the parking lot of the North Bend shopping center.

Ranger..I do realize he is in the US illegally. Do you really think that only Hispanics are here illegally? I, unlike you, could careless about his race. It has nothing to do with the crime. Would it of made you feel better if it was a local coos county meth addict that committed the terrible accident?
There are no winners on either side of the accident. If we can't get past the race of the driver..then we will never learn from the tragic accident.

On a side note...I think the coffee stand that is being built in the middle of the mall is going to cause another accident of some sort. It right in the middle of the way. Taco Bell's drive through line goes right where the coffee stand is. So between the traffic for the mall, traffic for TB, traffic for the coffee shop and all the foot traffic..there is bound to be an accident. Hopeful not deadly like this one.

He came to this country illegally; broken law.
He traveled across this country and into the state of Oregon; broken law.

This is the deal: For those of you that support illegal aliens, I suggest you go to Mexico and help the Mexicans have a better life, but do it on your time and your budget. I feel he should been charged with two counts of Murder. He ran these two people over with his truck, and left the scene. Not even checking to see if he could help them. He didn't even dial 911. Sounds like Murder to me. Then to top it off he's in our country illegally. What would the Mexican police have done to one of us running down two of their own and leaving the scene? I feel our justice system needs to be looked at as well. More and more of this is happening around our country and the illegals get a slap on the wrist.

This is MORE than an issue about race and immigration but a point needs to be made regarding immigration:
1. Had this individual NOT been in the country, the Nances could have very well still been alive. There is no way that can be argued away.
2. You mention race. The corrupt legal system in this country has been bastardized by bleating heart politicians and judges, all because of RACE. If a WHITE guy had run over two mexicans, he'd be strung up for the next 20 years.

With up to 1 Year in jail. not only did he keep driving and the only way they found him is because his bumper fell off with the license plate on it, but he went home and cleaned his car completly inside and out, and dumped it and called and reported it stolen.

Negative Daniel. These people come here for basically three reasons:
1. Lack of work in their home countries because NAFTA killed the jobs in their countries.
2. Free health care/welfare/education that our corrupt politicians have put in place because of their misguided beliefs.
3. Greedy employers that will take advantage of cheap labor; read that as illegal aliens that know how to work the welfare system and willing to work for minimum or less wages.

Want a solution?
1. Build the fence across the US/Mexico border.
2. Boycott any employer that hires illegals.
3. Start the deportations.

Anyone here can start #2 immediately. If you refuse to do business with any organization that hires them, that business will get the message real quick and change their ways, or else face bankruptcy.
Personally speaking, I absolutely refuse to spend my money ANYWHERE I suspect they hire or employ someone from another country, legal or otherwise.
The rule of thumb is as follows: Those that have the most gold make the rules. As consumers, WE have the power and authority to determine who and what gets a job in the country.

I'm curious to why she got six months?
Mr. Moncanda got six years. One was an accident and one was the result of drinking and driving. They both drove off. In fact, it took a lot longer to find and charge the woman. What is the difference?

he has a wife and several children in mexico who are going to suffer from this , this is also a concern of his.

You know I can see why vigiante justice is making a come back. being a former Law Enforcement Proffessional, I have always told my superiors and the courts that this kind of justice is going to start making a comeback. Being in a small town where everybody knows you by your first name and your neighbors to these folks, you feel their pain, frustration and need for justice. Please realize that the law was followed. A first time offense does not warrant maximum sentencing. I know the issue bothers a lot of people because two lives were taken in a brief few seconds of bad choices and they don't think the perpetrator got a big enough sentence. The law is not supposed to be bias and in this case I don't think it was. The Judge did the correct thing. I don't know this man and most of you don't either. He has to live with his mistake for the rest of his life.

With Stone and Frasier in office this will happen again and again.

Here is a non citizen of the United States and a citizen of Mexico. Drives through the Pony Village Mall and leaves the scene of an accident. After he runs down 2 visiting people and leaves them to die.
Shame on court we have here in Coos County. He should have received 20 years if not more. If I said I was affraid would I get off. Let's all use that excuse.

I sure hope everyone here learned a couple of lessons from this....
1. If you're a legal citizen in this country, you're prosecuted to the FULL extent of the law.
2. It's better to live under the radar since under the current law, "they" have less incentive to prosecute and you have less to offer in return.

I know a teen who wrecked his car on purpose (for insurance fraud) and ended up killing his best friend in the process. He got more time than this guy. This is the case whatever nationality he is. We live in an area where there are few minorities, and the prejudice is coming out very strongly in this comments section. The most any of us could have gotten was 20 years.

From what I know of this case, he should get the maximum of 20 years. That is my only complaint.

Leave the race issue behind, because all it does is show your own ignorance.

I wonder if Tim would really be able to back up his statement that he would not change his opinion and not hate this person if that were his parents, child, or spouse that was left to die that night....if so, WOW. I am driving to teach my 16 year old that driving behind the wheel of a car is just like having a loaded gun in your hand. It can be dangerous and deadly and should be taken very seriouisly. Thats the chance and responsibility we take every time we drive and must face the consequences for our actions, Period! Not wanting to face deporation because his life in Mexico might not be a bed of roses does not give a person the right to run people down and leave them like a piece of garbage on the side of the road and then to go to work like nothing happened...I'm sure life in Mexico doesn't look too bad right now compared to prison life with others who don't give a rats you know what about other human lives, his included.

This wasn't murder per se, but this was manslaughter, and his disregard for the lives of these two people arguably contributed to their deaths. Ten years, at least, is deserved for this kind of crime.

I'm very sorry for the loss of these lives, and agree that his sentence should've been a little greater...10 years, maybe? Not 25 to life, though. The fact that he hit those people causing their deaths wasn't the crime. This wasn't a murder. He panicked and fled the scene. THAT was his crime. Was it horrible? Yes...definitely. He had a choice to make that night. He could stay and take responsibility while facing deportation as a result of the accident...or he could flee and attempt to continue his life as normally as possible. We can't presume to know what kind of life this man has lived and didn't want to return to in Mexico...so we shouldn't judge him so harshly. He made the wrong choice that night...but we've ALL been faced with tough decisions and made the wrong choice. He'll live with this for the rest of his life, as we all have to live with our mistakes. Do I feel sympathy for him? No. Not really. I believe the punishment just about fits the crime in this case. Will I judge him or hate him for it? No. If it were MY family members that were killed that night, would it change my opinion? No. Hate the tragedy...NOT the man who caused it.

yes, he should get life - he did end two lives. People who are rapists get 8 years - he kills 2 people - shows no concern - has his family help him leave area by gathering funds - and he gets an easy walk in the pokey! Oregon is just showing that it is better to kill then rape now!

This is so unfortunate, I am sorry for your great loss. The reality is that humans committ stupid acts whethere it be driven by fear, self-fishness, negligence, deviance etc... driver's license is not the issue.. people will drive with or without it (e.x. those that get suspended for DUII's-and have caused fatality also). Personally I feel much more comfotable giving people D.L so at least there is some kind record of who they are and where they reside. I do think the penalty should have been greater as what he did is a painly a gross crime. Illegal immigrants are not the only ones that kill millions of people each year, its human beings that are negligent and at times flat out deviant.

Dave, Mr. Moncada has all the qualities and personaltiy traits of the clowns in Salem that write the laws and determine some sentencing guidlines. You get what you vote for, and I think Mr. Moncada could do just as good a job as the current crop of itiots in Salem.
