Recordings shed light on Coquille man's arrest

More than two weeks have passed since the arrest that morning in Coquille, which dramatically changed the lives of Carl T. Foster; his daughter, Kaycee Faught; and Coquille police Officers James Bryant and Chris Webley.

Now, with the release of the radio and 911 calls from the incident, the public can hear the actual events as they happened.

On Jan. 12, Officers Bryant and Webley went to a house on East Third Street in Coquille to question Foster in connection with a criminal mischief complaint filed the day before. Coquille Police Chief Michael Reaves said a woman had accused Foster of following her and Foster’s ex-girlfriend as they left in a car from the man’s house on Shelley Lane, blocking them with his truck and smashing the car’s windshield with a hammer.

A press release from the Coos County District Attorney’s Office indicated that Foster resisted arrest; that the officers pulled him to the ground, each grabbing one of his arms. Then, the officers noticed Foster wasn’t breathing and had gone limp. Foster was eventually life-flighted to Sacred Heart Medical Center in Eugene, where he underwent surgery to a fractured vertebra.  

On Wednesday, at the request of The World, officials at the Coos Bay Police Department released three audio recordings of the Foster incident. One is of the original 911 criminal mischief call on Jan. 11. The other two recordings center on the actual incident: One is of the radio traffic between a dispatcher and officers at the scene during the arrest. The other is of dialogue between medical crews and a dispatcher.

According to a Coos Bay Police press log, the original criminal mischief call to 911 from Lucile Phillips, 80, of Coquille, came in at about 12:50 p.m., Jan. 11.

On the tape, Phillips said a man had stopped his truck in front of her car as she drove with her passenger on Shelley Lane.

After the man stopped on the roadway, he tried to get into her car, she said.

“We had the car locked and we wouldn’t open the door,” Phillips said on the tape.

The man went back to his truck and grabbed a hammer, she recounted.

“So he went back to his car and got a hammer and pounded the windshield out,” she said.

Phillips described her attacker as an older white man with gray hair. The dispatcher told Phillips she would send out an officer to speak with her.

At 9 a.m., the next day, Bryant and Webley arrived at the house where Foster was house-sitting. The tape reveals that after their arrival, an unidentified officer called dispatch to request medical assistance. Then, a second officer called and requested immediate help.

“If you could expedite, he’s not breathing,” the officer said.

While officers worked at the scene, at about 9:09 a.m., the dispatcher paged crews from Coquille Medic One to go to the home.

“... Request you respond to 440 East Third Street. Officers on the scene at that location advising they need medical ASAP,” the dispatcher said.

The dispatcher asked officers at the home to provide more information on the nature of the medical emergency.  An unidentified officer told the dispatcher that Foster “attacked us, we took him to the ground, and he’s not breathing. Saying there is pain in the chest. There is no obstruction of the airway.”

The dispatcher then passed the information on to medical crews. They arrived at the house and told the dispatcher they were taking Foster to Coquille Valley Hospital, arriving there at 9:27 a.m. Complete transcripts of the recordings are printed in sidebars accompanying this story.

Faught, of Yakima, Wash., remains in Eugene, at her father’s bedside. She said he had been moved to the fourth floor ICU Wednesday and has shown some small improvements. He is still on a ventilator and isn’t communicating much, but he is no longer on blood medication to regulate his heart rate, she said, adding this is a relief because his heart had stopped several times, causing quite a scare.

“That’s just part of the injury. It’s almost like your whole body is crazy,” Faught said, adding her dad recently started physical therapy. “He’s going on the right track.”

However, the chances of him getting off the ventilator and other life-support machines are getting slimmer by the day, Faught lamented.

As of this morning, Foster was in serious condition in the hospital’s intensive care unit, paralyzed from the neck down.

On Thursday afternoon, Coos County District Attorney R. Paul Frasier said the investigation into the incident is continuing. He is still waiting to receive most of the police reports and documents from the Lane County Medical Examiner before proceeding, he said.  

Coquille Police Chief Michael Reaves would not comment for this story, referring all questions regarding the case to the DA’s Office. A Coquille Police Deparment spokeswoman would not confirm if Bryant and Webley are still on the job.

THE 1st RECORDING: his ex-girlfriends mom did a lousy job of explaining what had happened in the beginning, and of who it was, she could have stated a name, but acted like she had no clue as to who it was, now, you tell me, why would she be parked in the middle of the road to begin with, with the car turned off? what she didnt explain was that they were in his driveway, and they were asked to leave more than once and did not...THE 2nd RECORDING: not even 2 seconds after they got there, they requested medical, first they said he had broken ribs, then they said he is NOT BREATHING, BUT COMPLAINED OF PAIN IN THE CHEST, explain to me, how someone can complain of anything, when they are NOT breathing?...THE 3rd RECORDING: the ambulance gets there, says HE IS NOT BREATHING, BUT HE IS CONSCIOUS... how in the world is someone NOT breathing, yet well aware of what is going on?
    I am just so glad i do not live in coquille any more, that is the only place coquille police officers think you are guilty until proven innocent, but the medical personnel obviously need to go back to school and learn that if he was conscious, he would be breathing... heaven forbid if anything happened to me there, i could have a headache, and they would tell me my toe was broken. my prayers go out to carl foster and his family all the way.

    I've been reading these comments and following this story from the beginning. And I must say I'm appalled. I am a former resident and now in the military over in Virginia and this is my take on it all: Bottom line is, the guy busted an old lady's windshield out. Does that sound like a guy who needs a whole lot of sympathy? What could he possibly try to explain to the cops? People fall "wrong" all the time. Ie: a baby hitting its head on the corner of a table and dies, just because a man isn't in great physical condition, it doesnt give him the right to resist arrest. Focus your attention at the criminal, not the law. Thank you, and God Bless. Or maybe we don't want to focus on him either.....

    I think something must be wrong with this stroy from the point of view as in the transcripts of what the officers were saying is they had to "take him down" , he wasn't breathing, but complaining of chest pains and possible broken ribs. Well correct me if I'm wrong here and it doesn't take just a nurse to know that if someone isn't breathing they aren't able to tell you they have chest pains or anything else wrong!! I think the officers approached this man, he tried to explain what happened and the officers didn't care and tried to be the big shots and knocked the poor guy out cold, then tried to make up some crap of a story to cover themselves. Nobody I've ever known to not be breathing was able to say they had "chest pains"!!!

    Although I'm sure you, like much of the 'take no responsibility' society we live in, would search for a dozen angles you could sue on, taking no responsibility... I would not.

    No doubt you are the type that would jump from a bridge, then if you miraculously survived (but were injured) you would attempt to sue the bridge manufacturer for not having the foresight to place a trampoline beneath it, forgetting that you were the one that jumped, and that no one made you do it.

    Who made this guy resistive/assaultive towards the officers? Oh, that's right, he bears no responsibility for causing this whole mess.

    LEAVE IT ALONE...This should be a big deal either way you look at it. If you think the police were within their rights then you want to make a big deal out of it so they will be vindicated, publicly. If you think Mr. Foster was a victim of police brutality then you certainly want to make a big deal out of it so that he gets justice. One thing nobody reading this paper needs is for someone to tell them what to do, its none of your business what the rest of us do!

    Actually, police would LOVE to do more drug busts, but they are too busy handling YOUR petty theft when you keep your cars/homes unlocked, or your purse stolen from your cart at Walmart when you leave it unattended, or your stolen car report when you've left it in the driveway running with the doors unlocked... oh, and don't forget barking dogs and calling the police just because someone was rude to you somewhere, or when you call the police to come tell your neighbor to turn his stereo down - because your too lazy or scared to do it yourself...

    Do a public records search - google Coos County crime statistics - some of the databases require a fee - even The World has published statistics - They are out there, I have done my homework, you do yours. Then let us divide the number of any major drug busts into the annual salary totals of law enforcement here and see what it costs per conviction.

    The charge that Foster resisted arrest is not yet a proven fact. After he was taken down for whatever reason, and the seriousness of his resulting injuries became apparent to them, it is not likely that they would say anything other than that he resisted and/or attacked them.

    This morning I drove by 440 E Third St. It is very open to view from the well travelled street, many houes are nearby, and you could easily hit the Coos county courthouse with a rock thrown from there! The official version of the unrecorded parts of this incident just doesn't pass the smell test so far. Someone probably did witness at least some of the incident, given the time and place, so let's hope they don't feel intimidated to come forth and clear this up.

    I don't see or hear anything that wasn't already reported. These tapes don't prove innocence or guilt of either party. We still didn't hear exactly what happened, only what was said to dispatch afterward.
    How could Mr. Foster be "Saying there is pain in the chest." yet he had to blink his eyes later to communicate with his daughter. How could he speak when he wasn't breathing. I understood that when spinal injury occurs the trauma is immediately manifested.
    Citizen for our Police and Disgusted...What tapes did you listen to? You must have heard something different than what I heard or read. There are no facts about the incident in these tapes.

    Thanks for obtaining these recordings, but they really don't provide much more information about what really happened to Mr. Foster than the original news reports. For the sake of everyone, let's hope some of the neighbors observed this incident, or that a police recording of the alleged arrest and takedown actually does exist.

Carl Foster is my uncle.The police should not have used such force to hurt him like this.He's a small guy.I think if the police were acting professionally they would have done things differently. They train for years. Theres so much more that is not being said. A lot of people are suffering. I visited him several times and he says he scared. Paralized from the neck down who wouldnt be.

    I dont care what state you live in, Police Officers, (or should I say Peace Officers, the correct word) are there to serve and PROTECT. Injurys like this are happening everywhere and I dont feel that is protecting anyone. Police brutality at any rate is so UNcalled for. We, the people, are paying all officers wages and salaries. I am not paying them to be brutal to anyone. If i were to do that to another person, I would have not only been charged with assault, but also with attempted murder, are these officers going to get charged? I think not, and to be honest, i dont feel just because you wear a badge, it gives you any right to be able to treat anyone differently, and get away with it. I personally dont know the officers or the gentleman that was wounded, but i would like to see these officers get repremanded and not only suspended, with pay. No pay for them, and a little jail time would do them good. Maybe that way, they could get to know their people they have previously arrested, better. Did it ever occur to them, that other states take things into their own hands, such as drive by shootings? look out coquille, your making the whole world, not just the town mad.

    The person reporting the "crime" to the dispatcher said it happened around 10a.m., when the time line began shortly after 9a.m.,
    The man couldn't breathe but talked? He couldn't breathe but was concious?
    How long can a person go without breathing and stay concious?
    Then it states that the man attacked the officers, according to them,(officers);
    I do believe they would of said anything to cover their butts, knowing something serious had happened in the take down of Mr. Foster.
    Lucile's windshield is a minor factor in all this...maybe her insurance will pay for it.

    How did Mr. Foster "said" he was having trouble breathing? Mr. Foster didn't say anything after he hit the floor. Did you even think it through?

    Cute to release the previous days' audio of the 9/11 tape, right? What the heck difference does it make? The issue is what happened the next day, remember? How convenient there is no recording of when they broke his neck.

    Nixon tried it, folks, didn't work for him, the "missing" tapes won't work for these clowns.

    Will all you "defenders" of the police in Coquille gladly pay for their abuse? It's going to cost the city a pretty penny, and then maybe steps will be taken to shine light on what's going on.

    This is so sad, COOS REDNIKK, I'll pay the durn windshield bill, cuz you're going to pay a lot more for Mr. Fosters' care.

    No one believes they intended to break Foster's neck... what is believed is that they used more force than was necessary, that it is not the first time they have used undue force AND that they were not expecting it to go quite this bad

    It all sounds legite to me-you can't make up a 911 tape. The officers can't make up stories when it is action-reaction. Split second decisions and actions have to be made. Our officers are decent, honest professionals, they would never hurt anyone intentially. They only did what they are trained to do in the siuation when a suspect takes a swing at them and resists. Hang in there guys, you did nothing wrong!!
