State reveals violations on vet

COOS BAY - The Oregon Veterinary Medical Examining Board recently disclosed examples of what it deemed unacceptable medical care performed by a local veterinarian whose facility was recently shut down.

On Saturday, Dr. William Powell, the target of the probe, assailed the accusations at a rally on his behalf at Mingus Park, in the wake of receiving additional documentation from the Medical Examining Board that it's expanding the inquiry.

In a July 2 letter to Powell, the Examining Board Director Lori Makinen advised Powell the board intended to revoke his veterinary license for presenting a serious danger to public health and safety and for performing “unacceptable patient care.”

Powell's operation, the Low Cost Spay & Neuter Clinic, has conducted more than 18,000 spays, neuters and some emergency operations for the last seven years. The popular clinic, most recently located in Empire, was shut down last Monday.

Makinen's letter indicated if Powell signed an agreement over the matter, the only public information released would be a settlement document stating Powell agreed to the “voluntary surrender.”

“If you do not sign and return the attached settlement document within five days, the board will issue the order and notice which are public documents,” Makinen wrote. “These documents will contain some of the alleged facts and violations that convinced the board to take action ...”

Since Powell did not sign the board's agreement, and has instead decided to fight the allegations, the board released records of several pet visits to his clinic dating back to 2004, including:

n May 19, 2004: Powell performed a spay on a kitten named Dory. A few weeks later, Dory was taken to another veterinarian with an infection. During exploratory surgery, the vet discovered a duct that carries urine from the kidney to the bladder had been tied off along with the cat's ovary. Dory's kidney was removed.

n March 12, 2005: Powell performed a spay on a dog named Roxy. Six months later, another veterinarian treated the dog for an ailment and discovered an obstructed kidney, likely linked to tying off of a kidney duct during spaying, according to the medical board.

n Nov. 19, 2005: Powell attended to a dog named Taz, which was vomiting. Powell diagnosed the problem as salmon poisoning but, according to the medical board, did not conduct an examination or any diagnostic testing. Powell prescribed three medications. The dog's owner returned several minutes later, claiming Taz had stopped breathing and had a swollen tongue. Powell again diagnosed the problem as salmon poisoning. The pet owner sought a second opinion with another veterinarian who successfully treated the dog with a genital tract infection, according to the medical board.

n Jan. 11, 2006: Powell diagnosed three shelter dogs, Riley, Ben and Molly with canine hip dysplasia and operated on them without conducting X-rays. Another veterinarian who treated one of the dogs later on, used an X-ray machine and found no evidence of hip dysplasia or osteoarthritis, according to the medical board.

n Dec. 14, 2006: Powell saw a dog named Biscuit which had likely been hit by a car. Powell did not perform X-rays, according to the medical examining board, but did apply a splint to the dog's leg. Less than one month later, another veterinarian treated Biscuit and after X-rays revealed fractures in Biscuit's knee joint, femur, pelvis and a swollen foot bone. The dog was euthanized, according to the medical board.

At Mingus Park, Saturday afternoon, dozens of people attended a rally and potluck for Powell. Many signed petitions, donated money to the veterinarian's legal fund, and spoke of the work he had done on their animals. He said he met with and hired an attorney Friday.

Powell said he would not comment extensively on some of the charges because they will come up in court. However, he said they are “inaccurate and riddled with half-truths.” One case, he said, just didn't happen.

“They have taken rumors and innuendoes and stated them as fact,” Powell said. “What I think about it is not fit to print.”

In the case of Biscuit, Powell said the owner was heading to New Mexico and when he encouraged her to get X-rays for her pet, she declined. She said she couldn't afford it, and then signed a waiver.

He did allow that some of the cases are partially true.

“We had a problem with one of those cats, but 90 percent of it is either whole cloth or erroneous,” Powell said.

Because his own clinic did not contain an X-ray machine, Powell often referred clients and their pets to other practices.

Powell received another letter from the Veterinary Board on Saturday morning, asking him to provide medical records and a brief summary of his treatment of four animals, listed only by the dogs' names and approximate dates of care.

The veterinarian said he would not search for any of the records, which are listed by the owners' names rather than the pets. He said he didn't believe he and staff should waste time scouring records in search of dogs with generic names such as Belle and Guy.

“That would be a fool's errand,” Powell said, “What it's designed to do is to get me ... over there (to) spend day and night (looking) for nonexistent records.

“It's getting kind of funny. They can't hurt me more than they already have.”

Powell said he believes the board will add four more charges to his litany of violations because he won't be able to produce the records.

The letter was photocopied and passed out to people who attended the potluck.

Many who saw the letter echoed Powell's sentiments, including supporter Cindi Johnson of Coos Bay.

“I think they are lies,” Johnson said, adding it seemed suspicious to her that the requested records do not offer specific dates. She also said she didn't understand why a client would go to another veterinarian if complications occurred after a pet's surgery, rather than going directly to the doctor who conducted the operation.

“If he's so incompetent and dangerous, why did it take them this long to shut him down?” Johnson asked.

North Bend resident Marilyn Dow, who came to the potluck in support of the veterinarian, said she donated money and signed a petition at the event.

“I can't believe that we could allow him to close up. We've got to continue fighting for the man. For us and for him,” Dow said.

One of Powell's clients began to cry on the shoulder of Shawn Gayhart, an employee and supporter of the veterinarian.

“Don't cry. We've only just begun to fight,” Gayhart said.

This is an all too familiar scenario with many of the doctors in this town, including doctors other than vets. Good Ol' Boys. They think that they own this community. They're trying to chase Dr. Powell out of town, my own vet included and they don't care what they have to do or destroy to accomplish this. Let's look at the track records on any of the other doctors in town. I'm sure if their records were scrutinized, most of them would look much worse than Dr. Powell's. Good Ol' Boys. Shame on them! Shame on us if we let them get away with this.

i believe we can choose our own vet and i don't understand why we cannot choose to do so. i have been going to dr powell for years even when he was at the mall and now that he is in empire area. just like humans going to a doctor we sign a waiver saying we will not sue him and he does everything he can this includes dr powell suggesting going somewhere else. if he doesn't have an xray's then we need to go somewhere else. he has helped so many of us in this this low income community i don't see why other vets want to report him. besides ---you got it , MONEY. we all choose our own vet , because we believe in him and his staff. if the other vet's honestly believe we are going to stop to going to dr powell and start going to do business with them they are wrong !!! we will stand our ground and wait for dr powell to be back in business. dr powell and staff dedicate their time to support the over population of animals and care about the health of the animals not money. i cannot count how many times i have heard thru the grapevine that dr powell has helped someone . this is a business that wants to help us, why can't anyone see this and drop the issues . many of these are not true they are gossip. wonder from whom ? we should be able to choose who we want to help our animals not politics or other vets . to the other vets , we won't change vets so starting this whole action is a waist of your time we miss him and his staff and services because they care about us. i think the board should investigate all vets and announce all findings in the local newspaper as well. reminder : sometimes things happen during surgery not only for pets for humans too. if the issues are true and i heard they are not true they are made up, but if they are, sometimes during surgery things do go wrong, just like when humans go into surgery we sign a paper saying "just in case" don't sue us. this is way out of hand and dr powell needs to go back to practice where he is missed and does the good of the community. are the other vets jelious ? did they pay for the board to come into town and investigate ? why would they do this if it is not for money ? all vets do believe " the best for animals " right ? they are dedicated to the animals , right ?

There is no "other vet" out to get Dr. Powell. He "got" himself by overstepping his bounds. Who splints a dogs leg without having done x-rays??? Apparently this dog suffered in pain for 3-4 weeks having many other broken bones. Who did he help in the long run? Then trying to blame in on the dog owner because she knew the dog should have been x-rayed. Who is supposed to be the professional? Unfortunately for the dog, she suffered terribly before she was mecifully put out of her misery. Dr. Powell should have just said "no" on this one! Also, if you read the letter from the Board, Dr. Powell WAS given time to correct problems and he did not. I am all for affordable veterinary care but I refuse to accept sub-standard care for my beloved pets. Misdiagnosis happen, but if standard tests were run, something wouldn't have been diagnosted as salmon poisoning if it was not salmon poisioning. I personally had an issue with one of my pets. I thought it should have been a simple fix. It seem to be fix but the next day, a day when the clinic was closed there was an issue I had not recourse but to take the pet to another vet. Yes it cost me more money but I came away with correctly fix problem, proper medication and a phone call the next day from the vet for a progress report. I know this community needs a Low Cost Spay/Neuter Clinic but not at the cost of quality pet care. I think the clinic got too busy, the Dr. didn't ave enough time to see all the patients but let his staff take a jab at diagnosisng things. We need to hold Veterinarians accountable the same way we hold our own physicians accountable. Guessing at what a problem is, is not good enough for my pet and it shouldn't be enough for yours either. How is hip dysplasia diagnosed without x-rays? How can you tell what kind of skin disorder the dog is having without doing skin scrapings? I watch animal planet and they can't tell what kind of mange a dog has without skin scrapings. How come those people on TV don't know as much as Dr. Powell?

My family has taken several animals to Dr. Powell. I have 5 alone that he has either spayed or neutered. Never have we had any complications or negative reactions with these proceedures. I can pick them up and hug each one of them. Had it not been for Dr. Powell and his fine clinic, excellent and caring staff I could not have afforded to have them altered. Thank you Dr. Powell, I and my family stand behind you 100%

By the way, I have absolutely no reason to believe this is anything other than a ploy by at least one other local vet (vets who, again, are CERTAINLY not of the utmost quality in almost all cases, but who are of the utmost expense) to get more business. Powell ran a great business as well as he could without some expensive technical tools, with extremely good success rates and great veteranary know-how.

I want to come to defense of this man... he's provided a good service, in my opinion, to just about everyone. I can tell you right now, he has saved me a LOT of money and hardship, by not having a potentially deadly surgery performed on my pet (which was suggested, at high cost, by Ocean Blvd. Clinic) when it was absolutely not needed. It is sad that he is not perfect, but I can tell you that other vets in the area are FAR from perfect themselves...

I have a three year old male cat. A few months ago my cat had received a bit on the side of his face that had caused him to run a high fever and his face to swell. Dr. Powell examined my cat, this included checking his temperature and a general well being exam and then explained that the swollen area on his face would have to lanced. Dr. Powell performed the surgery and my cat is healthy again. He was a great hunter and thanks to Dr. Powell he is still a great hunter. Dr. Powell has obviously been an assett to this community and if the board can honestly provide proof that other vets in this community have never made mistakes in diagnosis or surgery on a pet, then maybe we can all take into consideration that no one is perfect 100% of the time. 18,000 spay or neuters in seven years. The board needs to work with Dr. Powell and help keep this practice open for our community members that can not afford $1000.00 vet visits, that are absoultely insane to charge. The problem I see here is that other veterinarians in the community are looking to make huge amounts of money treating beloved pets and are not sensitive to the hardships it puts on the owners that are not rich. It is not good enough to say that people need to afford to be able to care for their pets prior to owning one, vets need to be a little less expensive so that all people can enjoy the same benefits of pet ownership.Dr. Powell has provided these services to pet owners for many years and should continue to be allowed to perform these services for area residences. We need veterinarians like Dr. Powell who will help low income families afford to have pets and be responsible pet owners by offering low cost spay or neutering. Wendy Wade

Where in any of the information from the Oregon Veterinary Medical Examining Boards charges did it state that Dr. Powell was shut down because he provided a good service to the community at a low cost? Please someone point that out in the information that was provided. It looks like they are doing their jobs to help protect innocent animals from being harmed.

"18,000 spays, neuters and some emergency operations" and a handful of problems. Someone needs to investigate the investigators. The State should look into ways of helping this doctor rather that closing him down. How about an x-ray machine?

Something I forgot to add all these animals that they say he misdiagnosed why are they only giving him the name of the animal when he told them he goes by the name of the owner. If this is all true facts give him the name of the owners for goodness sake!!

This is an outrage!!! I have been a pet owner for many years.. about 3 yrs ago one of my animals was hit by a car the driver did not stop i took my dog to the vet not dr powell that vet charged me more than i make in 3 months and had me pay in post dated check couldnt tell you how many i had to write.there was no surgery involved.they cleaned my dog up and gave him antibiotics and kept him over night and it cost me over a $1000.they told me he was fine 6 months later he died. I now have a puppy i called a vet several months ago because my puppy had a hernia. they quoted me around $400. I took her to Dr.Powell he charged me $70. I could not tell you how wonderful he was it was the first time a doctor has ever called me after my animal was home to check on them but Dr. Powell did he not only called me after we were able to bring her home but one of his staff called me right after her surgery to tell me she was fine and everthing went well. Now not only does that make him a wonderful doctor he is a caring person. The way i see it is there are many vets out there and it use to be they were there for the animals now they are there for the money!!! when a doctor like Dr.Powell comes in and is not there for the money his main concern is our animals. So now you have a bunch of vets whom are losing business so what better way for them to get their business back but to make up alot of bull to get Dr.powell out of here. Its all about the old mighty dollar sad but true. Also i want everyone to know that we should stand outside of all the other vet offices and protest because of what they charge also because if you find a sick animal on the street good luck finding a vet that will take that animal in without payment and they do not care who pays so long as it is from someone.I truly believe that money exchanged hands from somewhere from a vet to the board for this to happen.But i tell you this we are not giving up without a fight so Dr.Powell you cant either. And you have alot of people in this community standing not behind you but beside you..

I wonder what violations the veterinary board would find if they bothered to investigate the complaints made AGAINST these "other" veterinarians, instead of just investigating complaints made BY them. Money. That's all this comes down to, and everyone knows it.

Our Doctor is a wonderful man! We have brought many, many animals to him,as we do rescue and have paid for the low cost spay/neuter for many people who cannot aford it. Our Doctor Powell has ALWAYS gave his upmost care,and on the occasions that he thought a lab test or x-ray diagnosis should be made,he always recomended a place to go for that. I,m sure EVERY vet has made an occasional mistake or misdiagnosis.This whole thing is shameful and ridiculous. And while all this is slowly playing out,the innocent animals are suffering,reproducing and being neglected because we have no low cost veternarian.We are VERY proud of him and will always be there to support him. WE LOVE OUR DOCTOR WE TRUST OUR DOCTOR WE NEED OUR DOCTOR

There are plenty of responsible pet owners that can't afford prices for spay/neuter fees such as Harbor Lights astronomical fees. Dr. Powell provides a service that is economical for those of us that don't want to get price gouged! Shame on the licensing board for shutting him down. Every doctors office has it's faults, even human doctors offices!

I've followed this story for a few days in the World On-Line from far away in Alberta, Canada. I've had no experience with Dr. Powell to bias me one way or another regarding the claims in this story. It sounds as if Powell has performed a much-needed service to the community and practices genuine altruism toward those who have pets and face medical difficulties. It also sounds like there may be some legitimate complaints: documented cases of clinical or diagnostic error that this doctor may have been involved with. Doubtless, this is a serious frustration to other veterinarians who have to try to repair the mistakes. Anyway, my point is this: anyone who performs the sheer number of procedures that this man conducts is bound to make a few mistakes. It just happens to show up more in a veterinary practice. (Those of us who operate a backhoe and hit a water main, for example, can repair our mistakes with little outcry from peers or the public.) I suggest there is some serious professional arrogance behind the scenes here on the part of the board and/or other local vets. Unfortunately, they have the weight of data and position on their part, and the good doctor is bound to go down. He won’t win this one, but he’ll have a lot of sympathy on his journey.

This is an outrage! I see the pet population exploding again without Dr. Powell's services of spaying and neutering. This man has saved several of my cats; without him I would have lost my beloved pets because I am unable to afford the costs of other veterinarians in the area. What are the lower income people with pets supposed to do now? Give up our furry friends because we can no longer afford what it will cost to care for them?

What is the real problem here? All the other vets are losing business because of Dr Powell...Well too bad, try and fix this problem by doing the spay and neuters at a reasonable rate. I saw the rates of other vets, for heavens sake I would go to Dr Powell before paying one of the other rates...But no!! Someone is obviously causing a stink and it smells like a local Vet.

I have four cats and I am very thankful for dr powell hey spayed all four and they are in great health. I could not of afforded to take them to another vet. He is a god send for feral cats!!!!!!!!!!!!

Dr. Powell has helped many people, including myself...I would have lost my dog if it wasn't for him...he does not deserve to be closed down...Sometimes it cannot be helped, mistakes happen...people need to realize that, no matter who they take their pet to. We need to look at the fact that he has helped more animals, than not...I think people need to get off their high horse and keep that in mind...he is a wonderful man, and if it wasn't for him, more animals would suffer, because it costs an arm and a leg to take your pet anywhere else...I think most people would agree with me there...

I can not tell you how greatful we have been for dr. powells office! I have never been able to take my pets to a vet with out worring about how much it is going to cost. His staff is wonderful as well. I have three cats and two dogs of which Dr Powell has seen three with out his clinic i dont know where we'll go. It is truley unfair.
