Clinic closure provokes letter to the state

COQUILLE - The Coos County Board of Commissioners sent a letter Wednesday to the Oregon State Veterinary Medical Examining Board, expressing disappointment over its recent decision to shut down the Low Cost Spay & Neuter Clinic in Empire.

On Monday, the medical examining board suspended Dr. William Powell's veterinarian license for violating several Oregon veterinarian laws and gave him formal notice it intended to permanently revoke him from practicing veterinarian medicine.

The move sparked denials and a rally Monday on his behalf by locals who have come to rely on Powell for inexpensive veterinarian services. His clinic has provided more than 18,000 spays, neuters and some emergency operations for the past seven years, first at the Pony Village Mall in North Bend, and the past 21/2 at 132 N. Wasson St., in Coos Bay.

The popularity of the clinic and its subsequent demise prompted the county board to action Wednesday.

“We respectfully ask the (medical examining board) to consider the needs of low-income residents who own pets in our county,” the letter, signed by Coos County Board Chairman John Griffith and commissioners Nikki Whitty and Kevin Stufflebean stated. “We also ask board members to consider what a reduction in affordable spay and neuter services will mean to the county in terms of increased, unwanted puppies and cats.”

The commissioners noted the average per capita personal income in Coos County is about $27,000 annually.

“If that's the average, than there's an awful lot of people making less than $27,000,” Griffith said at a county administrative meeting early Wednesday.

He later added that many of the county's residents, who have low incomes, want to care for their pets - but cannot afford to pay more typical veterinarian bills.

“It's going to leave a lot of people stuck,” he said.

The county officials were not interested in “sticking its nose” in the state licensing board's business, Griffith said, nor, in sparking a “war” with local veterinarians. He said he realized there were many good veterinarians in the area and that as the enforcement arm for the state, the medical examining board is required to ensure all veterinarians adhere to state law.

But, he wanted to impress upon the medical examining board that “our folks are struggling financially” and that services like Powell's are needed.

“We are not a wealthy county,” the letter stated.

In a July 2 letter, the Veterinary Medical Examining Board accused Powell of committing numerous violations, including not providing an adequate in-house laboratory; inadequate housing of animals; allowing veterinary assistants to induce anesthesia; improper record keeping; performing surgeries without a cap and gown; the surgery room not being in a designated area or the surgery room not being clean or orderly; failure to obtain client permission before using unorthodox or nonstandard methods of treatment; failure to properly isolate patients with serious infections or contagious diseases; and failure to perform diagnostics.

Powell, who's engaged an attorney to fight the charges has denied the allegations and vowed to appeal the matter.

“We're not laying down on this one,” Powell said Wednesday.

He said he appreciates the county board's support and believes it might help his cause.

“(The Oregon Veterinary Medical Examining Board) should consider the impact it is going to have in the community,” he said.

The county's decision to send the letter was triggered, in part, to fears that shutting down the clinic could correlate to an increase in the number of euthanizations administered at the Coos County Animal Shelter. It's been only recently, with the help of numerous volunteer groups, that the shelter turned the corner on euthanasia. In February, the shelter went one month without euthanizing any dogs - a statistic that hadn't occurred in more than four years.

Commissioner Whitty suggested a medical examining board member come to Coos County, and work with Powell and volunteer groups to get him back in compliance. According to medical examining board documents, two board members and an investigator were at the clinic on June 25.

On Wednesday, Lori Makinen, the executive director of the Oregon Veterinary Medical Examining Board, said she hadn't received the letter from the Coos County Board of Commissioners, but said the medical examining board had accepted letters from Coos County citizens regarding the closure of the clinic.

In response to the letters supporting the Low Cost Spay & Neuter Clinic, she said the board relies on facts and “can't ignore its obligations to uphold the law.”

“I just think people don't understand that,” Makinen said.

She added that Powell will have the opportunity to argue his case in front of a judge if he requests a hearing within 20 days. She said the board can't take final action without a hearing.

I have a novel idea. Why don't the vets in this area- where 70% of population is on some sort of public assistance- show their community involvement, their love for animals & their support for the working poor- who paid for the vets new offices, European vacations and new cars- by reducing vet fees for spay/neuters. Then maybe the working poor will not have to make a choice between responsible pet care and feeding their families.

How many of you vets have come to your office in the middle of the nite for a sick pet and not charged an arm and a leg? You are all so money hungrey you can't help a sick friend. Well leave Dr Powell alone, he has more passion in his toe nails then any of you. If the Coos County Commissioners don't have any thing better to do then, STOP taking the tax payers money envious, petty vets. Try looking in to the charges of the boot licking vets. I will NEVER use these vets here. I'll take my pet to another town. NEVER NEVER to one here. They are back stabers of there own kind. SHAME on you all.

I have used Dr. Powell for both of my pets. He has helped me keep both of my pets healthy. With out him I could not have one let alone two. I am new in town and I think him and his staff are great. I and my 2 little ones were treated GREAT and they both have GOOD health. The other vets in this town treated me and my little ones like numbers, they could not even rember any of our names. BUT DR. POWELL AND his STAFF did. I rescued one of my little ones from a bad puppy mill in Bandon. The dogs were cold and in mud up to there knees, I told one of the high and mighty vets about the conditions and he acted like I didn't say a word. He didn't want to get envolved. Why don't the vets do some thing about thoes places and leave DR. Powell alone? Have any of the other vets done any thing for the pets in this area except bleed the owners dry of money? The vet or vets are a sorry lot to pick on A man willing to help low income people. You don't have to have new cars and fancy offices to help a pet that is hurting and crying like my little one was doing. Dr. Powell is a good human being. What about the of the vets?

I have an idea that will work. Move the clinic to the reservation. It's close. It will do great good for all and yes there are enough Indian residents to warrant the need. The public would be welcome.The Coquille tribe has solved many problems that have beseiged this county and shown the ability to resolve issues that your "government" has failed to do so. It is coming up onto election time and im afraid elected people are up to their old dog and ponyshow re-election faces. Go to tribal counsel dr. powell.

it's a witch hunt, the board does not enforce the regulations unilaterly,go to their web site http://www.oregon.gov/OVMEB and look at the meeting minutes. this is a conspiracy started by a handful of "people" who think they could benefit from the clinics closure. i think they will suffer even more from the bad publicy. these are petty code violations and grossly overexaggerated complaints. what "professional" do you know who is 100%. take a dog to 10 different vets and you will get 10 different treatment plans. for one "professional" and their EMPLOYEES to publically defame and start rumors about another "professional" is unethical. try to provide low cost professional services of any kind in Coos County and you will get the same treatment. the all mighty dollar is clearly the master here. even if all the vet boards charges are true, and i can't see that, the punishment does not fit the crime.

A special thank you goes to the Coos County Board of County Commissioners. They are looking out for the needs of all the citizens in the Coos Bay area. It is obvious that Dr Powell and his staff are a valuable part of our community. There are thousands of pets living a better life because pet owners could afford Dr Powell’s services. If Dr Powell’s services do not the high standards of the Veterinary Medical Examining Board, he should have a disclaimer stating so. Then the pet owners could make their own decision to use or not to use the services of the Low Cost Spay & Neuter Clinic. I have used the services of the Low Cost Spay & Neuter Clinic and always considered Dr Powell to be a country doctor. I like country doctors.

I just read a comment from a Questioning Citizen that is a little up setting. It's nice that they have the money to pay for there pets care. But there is to many pepole in Coos County that have little money. But they want to take care of there pets. If a Veterinarian can charge any amount they want most people can't pay. At lease Dr. Powell would help someone that found an animal that just got hit by a car. Most vet's seem not to care what you can aford.

I have never used Dr. Powell's services but I was planning on doing so with my new puppy to have her spayed. I am on disability so I am very low income and I was very happy to hear about him. This is a travisty. The main thing I have to remark about is in the original article in the world on 7-11. One of the vets,from the area made the remark that some of the vets or Coos County gives away 4 free spays or neuters a month!! How sweet of them that is just so special of them and so heart warming to hear! Wake up and smell the dog and cat poop, this is an extremly low income area the last time I looked around. My point is we need this compassionate man in our area and to close him down is wrong. We have people here who are really trying to be responsible pet owners and you are screwing it up. This is on the licensing boards shoulders when these poor people and these poor loved animals most of them family members have to be put down because they can't afford the horrible prices of the "real" vets. Fortunatly I have one that does help me well with my animals. Back to the four animals a month free, why bother it is not going to make a darn bit of difference due to the amount of animals in this county.

We took our dog to the vet and they charged me $210 for one shot and one application of medication. A year later, we had the same problem and couldn't afford to go to our vet, so we took our dog to Dr. Powell, who gave our dog the same shot, plus a shot to counteract any reactions to the first shot (which our vet never told us about) and application of medication PLUS follow-up medication, all for $56 and it saved our dogs life. Coos County Commissioners believe in the goodness in this county and they realize and accept that not everyone makes big money here. Since so many people won't allow industry to come in to Coos Bay to earn a decent living, we must rely on what's here. Dr Powell is a God send and he should be allowed to continue helping people in the positive way he does. He doesn't take business away from other vets. If it weren't for him, there would be more sick animals and more unwanted animals running around. My animals love Dr. Powell and so do we!

Its not a frivolous persuit! There is a ton of unwanted animals running around that need spayed and neutered,and this agency didn't even give Dr.Powell a decent amount of time to correct the problems.Most the animals brought to him are stray and so big deal if he uses an older method of medicine on them.It does the trick :) If others don't want to take their special loved animals to him,then so be it,but leave Dr.Powell alone to do what he can to save the people who can't afford to go elsewhere and the unwanted strays a favor.I have taken plenty of cats to him to have neutered and spayed who don't belong to me.They are ferel and strays who just happen to come hang out on my 10 acres.I recently called 2 vets in town for price quotes for spaying of a female cat.The prices varied between 89.00-242.00.How redundant is that?Especially ridiculous when the animals don't even belong to you,and I am just trying to keep the animal population under control.I have also taken my own pets to him and have had no problems at all.I am sure there is other vets in town ,people could say plenty negative about,not just Dr.Powell.I think he is a nice ,compassionate man,and has done the community a big favor :)Keep up the good work Dr.Powell !

I can not believe they are doing such a thing to this man or this clinic. If these people were so worried about their animals, then maybe THEY should have asked more questions & looked at the facility prior to taking their animal there. Prices are good to look at, but it doesn't always mean you are getting a good deal. Consumers need to be aware that it is their responsibility to look at things --- just like they do when they go to various supermarkets looking for that perfect price. I have had several of my animals seen at this clinic & guess what I still have them. On the other hand, I have taken 2 dogs to 2 separate local vets & lost both of them. Dr. Powell saved my old dog from a botched nueter from another local vet several years ago because of his willingness to see him after they released him on a Friday & problems arose on Saturday. Can't they weigh the good with the bad on this one? How many good things have happened from this clinic?

Dr.Powell, who I strongly support, had been anonymously reported to the board. This is as low as it can be. I myself have rescued many cats and paid thousands of Dollars for spay and neuter ( also to have the Spay and Neuter Mobile come here a few years ago ). A reliable source told me, that the Examining Board was informed by one of this town's vets who obviously thinks this is a legal way to rid himself of competition. You know who you are: SHAME ON YOU! How many animals will die because of your greedy action. This Saturday, everyone who wants to support Dr.Powell, can meet at 1 pm at Mingus Park.

If the problem you see is some elected officials going to bat for a citizen in trouble then, you need to figure out what they are elected for. When you question the number of animals who would die because of the clinic, please ask yourself about all the 1,000's of animals who will die without the clinic. Please think first. I think this is being fueled by other vets in the area. I have taken my animal to the old clinic at Pony Village as well as the current location in Empire. I have never had a concern or complaint about the way my animal was treated or cared for. The other vets in the area are having their business taken away because of their high prices which hardly anyone can afford.

Any time a vet can and did charge $85.00 dollars because I didn't have signed record of shots by DR. Powell they need to have a reality check. I was treated very bad by that office.

In addition, the Board voted to issue a Notice of Revocation (Notice), to permanently revoke your license. The Board acknowledges that you have practiced for many years and served your community with dedication. Thus, in lieu of the Order and Notice, the Board is offering you five days, from receipt of this letter, to sign and return the attached Stipulated Agreement and Final Order and voluntarily surrender your license. If you sign this agreement, the only public information will be the settlement document that states you agreed to the voluntary surrender. If you do not sign and return the attached settlement document within five days, the Board will issue the Order and Notice, which are public documents. These documents will contain some of the alleged facts and violations that convinced the Board to take action, including but not limited to the following: Case No. 2005-0029 You diagnosed a dog with salmon poisoning without performing the necessary diagnostic tests. The subsequent treating veterinarian diagnosed genital tract infection and provided IV fluids, Baytril and Metacam, which allowed the dog to recover. Your conduct constituted violations of: 1)Failure to perform and document physical examination in violation of OAR 875-015-0030(1); and 2) Failure to use generally accepted diagnostic procedures and treatments, without good cause which is a violation of OAR 875-011-0010(7). Case No. 2006-0009 You diagnosed three shelter dogs with CHP and performed pectinotomies on the dogs. You stated that the diagnosis was made by palpation and not radiography. The subsequent treating veterinarian for one of the dogs took x-rays, which showed no evidence of osteoarthritis or CHP. Your conduct constitutes three violations of: 1) Failure to perform and document physical examination in violation of OAR 875-015-0030(1); and 3) Failure to use generally accepted diagnostic procedures and treatments, without good cause which is a violation of OAR 875-011-0010(7). You were interviewed at the April 2006 Board meeting, and the Board determined that your practice did not meet minimum standards. You were provided time to bring your practice up to the minimum standards. Subsequently, on June 25, 2007, two Board members and the Board investigator inspected the clinic. They documented many conditions which violate the Veterinary Practice Act. 1. Inadequate in-house laboratory-No lab facilities or diagnostic equipment on premises, which constitutes violations OAR 875-015-0020(7) (a), (c) and (d). 2. Inadequate housing of animals-No kennel facilities, there is only a series of poorly placed/stacked airline carriers for housing and some hospitalized animals are tied to fixtures, which constitutes violations of OAR 875-015-0020(9). 3. Veterinary assistants are allowed to induce anesthesia, which constitutes violations of OAR 875-030-0050. 4. The pharmacy is not properly maintained-controlled drugs are not kept in proper storage, or a secure area; medications for human consumption (ibuprofen) are mixed with veterinary products; drugs are placed in numerous places around the clinic; and the controlled drug log does not posses adequate drugs for post op pain relief. These conditions constitute multiple violations of OAR 875-011-0010(16) and (17) and OAR 875-015-0030(6). 5. Improper record keeping-No physical examinations documents and no treatment plan, which constitutes violations of OAR 875-015-0030(1)(h). 6. Surgeries are not performed properly in that you do not use a cap and gown; the surgery room is not in a designated area and the surgery area is not clean or orderly, which constitutes violations of OAR 875-015-0030(2)(a) and (b). 7. Failure to obtain clients permission before using unorthodox or non-standard methods of treatment, in that you treat Parvo cases with collagen rectally, which constitutes violations of OAR 875-011-0010(8). 8. Failure to properly isolate patients with serious infections or contagious disease, w3hich constitutes violations of ORS 875-011-005(1). 9. Failure to perform diagnostics, i.e. fecal exams on vomiting/diarrhea canines, thus not able to detect infectious diseases, which constitutes violations of OAR 875-011-0010(7). All of the above demonstrate a pattern or continuous course of negligence, ignorance, incompetence or inefficiency in the practice of veterinary medicine, which constitutes violations of OAR 875-011-0010(2). Again, the Board recognizes your long professional career and your concern for the needs of your community. However, given the prolonged nature of the substandard conditions and practice, the Board is compelled to do its duty to protect the public and therefore undertakes the proposed actions described herein. It is anticipated that your decision will be one that preserves your professional reputation and allows you to retire with deserved dignity. Sincerely, Lori Makinen Director

You would think that the Coos County Commissioners would have better things to do with their time then petition for a Veterinarian that has had several direct violations stated against him by the Oregon Veterinary Medical Examining Board. All that the board is doing is their job, by protecting innocent animals and their owners from suffering from malpractice. How many animals have to die or suffer because of this clinic? I would hope that the Coos County Commissioners would focus on I don't know maybe the fact that there is a lack of law enforcement, public services, etc. because of their current actions. Stop wasting the counties money and time on frivolous persuits.
