NB football players facing Measure 11 charges

Two North Bend High School junior varsity football players who were arrested last week have been arraigned in Coos County Circuit court and now face at least two Measure 11 charges.
Jordan Akins, 17, and 15-year-old Bradley Kellerhals, were suspended from school Oct. 21, after school officials heard reports of two menacing incidents. One involved two of 12 students who were on a minibus ride home from a game against Sutherlin on Oct. 16. The other occurred in the boys locker room at North Bend High School.
North Bend Police officers became involved in the incident after dispatchers were informed by Bay Area Hospital personnel that a boy who said he had been sexually assaulted was brought into the emergency room on Saturday morning.
North Bend Police Chief Steve Scibelli said Wednesday that his officers are still conducting their investigation because of the number of people and witnesses involved.
"We expect to finish next week," he said.
The report will then be forwarded to the Coos County District Attorney's office.
Coos County District Attorney Paul Burgett said Akins and Kellerhals were arraigned on 12 counts each on Friday, including first-degree unlawful sexual penetration with a foreign object, conspiracy to commit unlawful sexual penetration, first-degree sexual abuse, attempted first-degree sexual abuse and conspiracy to commit sexual abuse.
Akins and Kellerhals are scheduled to appear for a plea hearing in a Coos County Circuit courtroom at 1:30 p.m. on Monday, Nov. 17.
According to state law, first-degree unlawful sexual penetration with a foreign object and first-degree sexual abuse are Measure 11 crimes. First-degree unlawful sexual penetration has a mandatory prison sentence of 100 months (eight years and four months), while first-degree sexual abuse has a mandatory sentence of 75 months, or six years and three months in prison.
Once the police reports are filed, Burgett said they will be given to the Douglas County authorities because the minibus incident occurred on state Highway 38, near Reedsport.
"We'll be referring information to the Douglas County District Attorney's Office when we get our reports," he added.
North Bend Superintendent Jim Howard said expulsion hearings are being held for the teens this week.
"We're in the process right now," he added. "I'm working on it to determine what we need to do."
Howard said he cannot discuss whether either student has been expelled from North Bend High School because it deals with student confidentiality. In general, Howard said, he takes a hard-nose approach to expulsions.
"I like to err on the side of expelling kids when we think the incident is proven and if it is serious," he said.
According to the superintendent, the incident has triggered a change in the district's policies regarding the use of the North Bend's two brown minibuses, which are usually driven by coaches or club advisors.
Howard said the school will require another adult be on board to provide adequate supervision. But he added, there are times - such as when a small groups or only a handful of students use the bus - that it is not necessary.
Howard said district officials also are keeping close tabs on the two victims in the menacing incidents.
"We are making sure they are comfortable and no one is giving them a bad time," he said. "The victims insist they are not getting any fallout from it."
